\tmso-pagination:widow-orphan; \tfont-size:10.0pt; \tfont-family:\"Times New Roman\"; \tmso-ansi-language:#0400; \tmso-fareast-language:#0400; \tmso-bidi-language:#0400;} <\/style>\n\n <![endif]-->  <\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">Seg\u00fan lo dispuesto en el <a name=\"OLE_LINK2\"><\/a><a name=\"OLE_LINK1\"><span style=\"\">Real Decreto Legislativo 2\/2008<\/span><\/a>, de 20 de junio, por el que se aprueba el Texto Refundido de <st1:personname productid=\"la Ley\" st=\"on\">la Ley<\/st1:personname> del Suelo, que en su disposici\u00f3n derogatoria \u00fanica, deroga todas las disposiciones de igual o inferior rango que se opongan al presente Real Decreto Legislativo y al Texto Refundido que aprueba y en particular, las siguientes:<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><!--[if !supportLists]--><span style=\"font-size: 11pt;\"><span style=\"\">a)<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">      <\/span><\/span><\/span><!--[endif]--><span style=\"font-size: 11pt;\">La Ley 8\/2007, de 28 de mayo, de Suelo.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><!--[if !supportLists]--><span style=\"font-size: 11pt;\"><span style=\"\">b)<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">      <\/span><\/span><\/span><!--[endif]--><span style=\"font-size: 11pt;\">El Real Decreto Legislativo 1\/1992, de 26 de junio por el que se aprueba el texto refundido de la Ley sobre R\u00e9gimen del Suelo y Ordenaci\u00f3n Urbana.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">Por lo que el <b style=\"\">Real Decreto Legislativo 2\/2008 pasa a ser la legislaci\u00f3n aplicable a nivel estatal,<\/b> y seg\u00fan se dispone en el Articulo 16.1. b) de dicho y texto refundido, en relaci\u00f3n <span style=\"\"> <\/span>los <b style=\"\">deberes de la promoci\u00f3n<\/b> de actuaciones urban\u00edsticas:<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">\u201c<b style=\"\">Entregara a la administraci\u00f3n competente, y con destino al patrimonio publico de suelo, el suelo libre de cargas de urbanizaci\u00f3n correspondiente al porcentaje de la edificabilidad media ponderada de la actuaci\u00f3n<\/b>, o del \u00e1mbito superior de referencia en que esta se incluya, que fije la legislaci\u00f3n reguladora de la ordenaci\u00f3n territorial y urban\u00edstica.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">En las actuaciones de dotaci\u00f3n, este porcentaje se entender\u00e1 referido al incremento de edificabilidad, media ponderada atribuida a los terrenos incluidos en la actuaci\u00f3n.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><b style=\"\"><span style=\"font-size: 11pt;\">Con car\u00e1cter general<\/span><\/b><span style=\"font-size: 11pt;\">, el porcentaje a que se refieren los p\u00e1rrafos anteriores <b style=\"\">no podr\u00e1 ser inferior al 5% ni superior al 15%.<o:p><\/o:p><\/b><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">La legislaci\u00f3n sobre ordenaci\u00f3n territorial y urban\u00edstica podr\u00e1 permitir excepcionalmente reducir o incrementar este porcentaje de forma proporcionada y motivada, hasta alcanzar un m\u00e1ximo del 20% en el caso de su incremento, para las actuaciones o los \u00e1mbitos en los que el valor de las parcelas resultantes sea sensiblemente inferior o superior, respectivamente, al medio en los restantes de la misma categor\u00eda de suelo.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\"><o:p> <\/o:p><\/span><\/p>\n<p class=\"MsoBodyText\" style=\"text-align: justify;\"><span style=\"font-size: 11pt;\">La legislaci\u00f3n sobre ordenaci\u00f3n territorial y urban\u00edstica, podr\u00e1 determinar los casos y condiciones en que quepa sustituir la entrega de suelo por otras formas de cumplimiento del deber, excepto cuando pueda cumplirse con suelo destinado a vivienda sometida a alg\u00fan r\u00e9gimen de protecci\u00f3n publica en virtud de la reserva que se refiere la letra b) del apartado primero del articulo <st1:metricconverter productid=\"10.\u201d\" st=\"on\">10.\u201d<\/st1:metricconverter><o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"\"><span style=\"font-size: 11pt; font-family: Arial;\">Del texto legal podemos destacar<\/span><\/b><span style=\"font-size: 11pt; font-family: Arial;\"> los siguientes elementos:<o:p><\/o:p><\/span><\/p>\n<p style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><span style=\"\">a)<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">      <\/span><\/span><\/span><!--[endif]--><b style=\"\"><span style=\"font-size: 11pt; font-family: Arial;\">Se trata de una cesi\u00f3n de aprovechamiento<\/span><\/b><span style=\"font-size: 11pt; font-family: Arial;\">. Luego habr\u00e1 que ceder el suelo necesario para obtener el dicho aprovechamiento, seg\u00fan <span style=\"\"> <\/span>corresponda por aplicaci\u00f3n de la ordenaci\u00f3n pormenorizada del \u00e1mbito de actuaci\u00f3n.<o:p><\/o:p><\/span><\/p>\n<p style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><!--[if !supportLists]--><span style=\"font-size: 11pt; font-family: Arial;\"><span style=\"\">b)<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">      <\/span><\/span><\/span><!--[endif]--><span style=\"font-size: 11pt; font-family: Arial;\">Al hablar de edificabilidad media ponderada, <b style=\"\">lo que se debe ceder es el porcentaje fijado en U.A <\/b>(cuyo concepto se trato en <st1:personname productid=\"la Consulta SU\" st=\"on\"><st1:personname productid=\"la Consulta\" st=\"on\">una publicacion previa de 13-7-10<\/st1:personname><\/st1:personname>)<o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><\/span><\/p>\n<p style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\"><!--[if !supportLists]--><b style=\"\"><span style=\"font-size: 11pt; font-family: Arial;\"><span style=\"\">c)<span style=\"font-family: &quot;Times New Roman&quot;; font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; line-height: normal; font-size-adjust: none; font-stretch: normal;\">      <\/span><\/span><\/span><\/b><!--[endif]--><b style=\"\"><span style=\"font-size: 11pt; font-family: Arial;\">La monetarizaci\u00f3n de dicha cesi\u00f3n<\/span><\/b><span style=\"font-size: 11pt; font-family: Arial;\">, aunque pueda estar contemplada, <b style=\"\">esta limitada a la imposibilidad de que no se pueda cumplir con la reserva de suelo para construir Vivienda de Protecci\u00f3n Publica.<o:p><\/o:p><\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><\/span><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"\"><span style=\"font-size: 11pt; font-family: Arial;\">Veamos un ejemplo de aplicaci\u00f3n<\/span><\/b><span style=\"font-size: 11pt; font-family: Arial;\"> <o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\">Utilizamos el sector A3, cuyos datos se incluyeron en una publicaci\u00f3n anterior referente la concepto de UA<o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\">. <o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\">El coste estimado de la urbanizaci\u00f3n del citado sector ascienden a un total de 4.000.000 de euros. En la legislaci\u00f3n urban\u00edstica de <st1:personname productid=\"la  Comunidad Aut\ufff3noma\" st=\"on\">la<span style=\"\">   <\/span>Comunidad Aut\u00f3noma<\/st1:personname> donde esta ubicado dicho sector se fija un porcentaje m\u00ednimo de cesi\u00f3n de aprovechamiento del 109% libre de cargas de urbanizaci\u00f3n. <o:p><\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\"><o:p> <\/o:p><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 11pt; font-family: Arial;\">Veamos como se cuantifica el aprovechamiento total y las cargas de urbanizaci\u00f3n, que le corresponde al Ayuntamiento, por cesi\u00f3n gratuita de suelo, si adem\u00e1s de poseer un 6 % como propietario en dicho sector, si adem\u00e1s pretende conseguir de la Junta que todo su aprovechamiento sea en el uso de VPP.<\/span><\/p>\n<p style=\"text-align: justify;\">\n<\/p>\n<p style=\"text-align: justify;\"><meta equiv=\"Content-Type\" content=\"text\/html;
