El objetivo propuesto por el cambio de solar por obra puede conseguirse por otras v\u00edas alternativas<\/b>, que pretenden <b style=\"mso-bidi-font-weight:normal\">soslayar los problemas de garant\u00edas o minimizar costes fiscales,<\/b> para lo cual se suele acudir a <b style=\"mso-bidi-font-weight:normal\">negocios indirectos<\/b> o simulando las posibles variantes son las siguientes:<\/span><\/p>\n<p style=\"margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;tab-stops:list 18.0pt\"><span style=\"font-size:11.0pt;font-family:Arial;mso-fareast-font-family:Arial\"><span style=\"mso-list:Ignore\">a)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">      <\/span><\/span><\/span><b style=\"mso-bidi-font-weight:normal\"><span style=\"font-size:11.0pt;font-family:Arial\">realizar la construcci\u00f3n a nombre del duelo del solar<\/span><\/b><span style=\"font-size:11.0pt;font-family:Arial\">, que aparece de este modo como \u00fanico titular del suelo y de l edificio construido sobre aquel, figurando como tal en todos los documentos y expedientes administrativos y fiscales, tales como licencia de obras, declaraci\u00f3n de obra nueva, declaraciones de IVA, etc.<br \/><\/span><\/p>\n<p style=\"margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;mso-list:l0 level1 lfo1;tab-stops:list 18.0pt\"><span style=\"font-size:11.0pt;font-family:Arial;mso-fareast-font-family:Arial\"><span style=\"mso-list:Ignore\">b)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">      <\/span><\/span><\/span><span style=\"font-size:11.0pt;font-family:Arial\">Realizar la construcci\u00f3n en nombre del promotor, al <b style=\"mso-bidi-font-weight:normal\">que no se le transmite el solar en documento publico<\/b>, y este a su vez, reconoce en documento privado la obligaci\u00f3n de transmitir, al due\u00f1o del solar, determinados pisos y\/o locales.<\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"font-size:11.0pt;font-family:Arial;mso-fareast-font-family:Arial\"><span style=\"mso-list:Ignore\">c)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">      <\/span><\/span><\/span><span style=\"font-size:11.0pt; font-family:Arial\">Realizar la <b style=\"mso-bidi-font-weight:normal\">cesi\u00f3n de suelo por vuelo en la modalidad de que existe un \u00fanico titular<\/b>, que aparece como \u00fanico promotor, resolviendo por negocio aparte la atribuci\u00f3n de las propiedades horizontales que le correspondan al due\u00f1o del solar del edificio y la garant\u00eda del titular oculto, que puede ser, seg\u00fan los casos, el due\u00f1o del solar o bien el promotor<br \/><\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"font-size:11.0pt; font-family:Arial\">Evidentemente <b style=\"mso-bidi-font-weight:normal\">los riesgos que puedan derivarse de este tipo de actuaciones, para el que deposita su confianza, son variados y graves<\/b>, destacando los casos de fallecimiento del duelo del solar o la insolvencia del promotor o del duelo del solar<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>En las promociones inmobiliarias, de viviendas, terciario o mixtas, una forma de adquisici\u00f3n del solar es la llamada aportaci\u00f3n que consiste, precisamente, en entregar el solar al promotor, a cambio\u2026 <a class=\"continue-reading-link\" href=\"https:\/\/prayde.com\/empresa\/aportacion-de-solar-modalidades\/\">Continue leyendo<\/a><\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[32,19,21],"class_list":["post-1882","post","type-post","status-publish","format-standard","hentry","category-sin-categoria","tag-contratos","tag-legislacion","tag-vivienda"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Aportaci\u00f3n de Solar.
