 mso-fareast-language:#0400;  mso-bidi-language:#0400;} <\/style>\n\n <![endif]-->  <\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">El d\u00eda 9 de noviembre de 2011 el Bolet\u00edn Oficial del Estado publica el <br \/><\/span><\/p>\n<h3 class=\"documento-tit\"><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2011-17629\" target=\"_blank\" rel=\"noopener\">Real Decreto 1492\/2011,<\/a> de 24 de octubre, por el que se aprueba el Reglamento de valoraciones de la Ley de Suelo.<br \/>\n<\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">Respecto al <b style=\"mso-bidi-font-weight: normal;\">Borrador inicial<\/b> de dicho Reglamento, <b style=\"mso-bidi-font-weight: normal;\">el actual RD presenta las siguientes novedades<\/b>:<br \/>\n<\/span><\/p>\n<p style=\"margin-left: 18pt; font-size: 11pt;\">El Reglamento se circunscribe <b style=\"mso-bidi-font-weight: normal;\">exclusivamente<\/b> al tema de las <b style=\"mso-bidi-font-weight: normal;\">Valoraciones Inmobiliarias de Suelo<\/b> a fin de mejorar<span style=\"mso-spacerun: yes;\">  <\/span>el funcionamiento del mercado de suelo para hacerlo mas transparente y eficiente combatiendo adem\u00e1s, en la medida de lo posible, las eventuales practicas especulativas en la utilizaci\u00f3n del mismo, desarrollando los preceptos recogidos en el articulo 21.1 del Texto Refundido de la Ley del Suelo, sin perjuicio de lo establecido en las normas especiales de car\u00e1cter financiero y tributario.<\/span><\/p>\n<table border=\"1\" cellpadding=\"0\" cellspacing=\"0\" class=\"MsoTableGrid\" style=\"border-collapse: collapse; font-size: 11pt;\">ES DECIR REGULA EXCLUSIVAMENTE LAS RELACIONES DE LOS PROPIETARIOS DE   SUELO CON LAS ADMINISTRACIONES<span style=\"mso-spacerun: yes;\">    <\/span>PUBLICAS Y EN PARTICULAR ANTE ACTUACIONES EXPROPIATORIAS O DE INDEMNIZACION<\/span><\/b><span style=\"font-family: Arial; font-size: 11pt;\">Con la publicaci\u00f3n de este Real Decreto, <b style=\"mso-bidi-font-weight: normal;\">queda derogado el RD 3288\/1978<\/b>, de 25 de agosto, por el que se aprueba el <b style=\"mso-bidi-font-weight: normal;\">Reglamento de Gestion Urban\u00edstic<\/b><br \/>\n<\/span><\/p>\n<p style=\"margin-left: 18pt; mso-list: l0 level1 lfo3; tab-stops: list 18.0pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: Symbol; font-size: 11pt; mso-bidi-font-family: Symbol; mso-fareast-font-family: Symbol;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font: 7pt &quot;Times New Roman&quot;;\">         <\/span><\/span><\/span><span style=\"font-family: Arial; font-size: 11pt;\">La <b style=\"mso-bidi-font-weight: normal;\">vigencia<\/b> de este RD 1492\/20011, comienza el d\u00eda <b style=\"mso-bidi-font-weight: normal;\">10 de noviembre de 2011<\/b>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">Como <b style=\"mso-bidi-font-weight: normal;\">novedades muy significativas<\/b> podemos destacar, entre las que se establecen en sus <b style=\"mso-bidi-font-weight: normal;\">cuatro tipos principales de valoraciones<\/b>, las siguientes<br \/>\n<\/span><\/p>\n<p style=\"margin-left: 18pt; mso-list: l1 level1 lfo1; tab-stops: list 18.0pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: Arial; font-size: 14pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">A)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">   <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 14pt;\">VALORACION DEL SUELO RURAL<\/span><\/b><span style=\"font-family: Arial; font-size: 14pt;\"> (articulos 7 a 21)<\/span><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">Establece como <b style=\"mso-bidi-font-weight: normal;\">m\u00e9todo general la capitalizaci\u00f3n de rentas anuales<\/b> por aplicaci\u00f3n de un <u>tipo equivalente al de la <b style=\"mso-bidi-font-weight: normal;\">Deuda<\/b><b style=\"mso-bidi-font-weight: normal;\"> P\u00fablica<\/b><b style=\"mso-bidi-font-weight: normal;\"> a tres a\u00f1os<\/b>, <\/u>(Disposici\u00f3n adicional s\u00e9ptima del texto refundido de la Ley del Suelo) estableciendo dos casos:<\/span><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">1)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">      <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 11pt;\">Suelo en Explotaci\u00f3n<\/span><\/b><span style=\"font-family: Arial; font-size: 11pt;\">, en cuyo caso, en funci\u00f3n del tipo de explotaci\u00f3n se introduce un <b style=\"mso-bidi-font-weight: normal;\"><u>coeficiente corrector<\/u><\/b> al de la deuda publica a tres a\u00f1os<br \/>\n<\/span><\/p>\n<p style=\"margin-left: 36pt; mso-list: l2 level1 lfo2; tab-stops: list 36.0pt; text-align: justify; text-indent: -18pt;\"><span style=\"font-family: Arial; font-size: 11pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">2)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">      <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 11pt;\">Suelo<\/span><\/b><span style=\"font-family: Arial; font-size: 11pt;\"> en el que no existe explotaci\u00f3n o que fuera <b style=\"mso-bidi-font-weight: normal;\">de imposible explotaci\u00f3n<\/b> dadas las caracter\u00edsticas del suelo, se aplicara como <b style=\"mso-bidi-font-weight: normal;\">renta te\u00f3rica <u>un tercio<span style=\"mso-spacerun: yes;\">  <\/span>a la renta real minima de la tierra<\/u><\/b> establecida a partir de las distintas estad\u00edsticas y estudios publicados por organismos p\u00fablicos e instituciones de acuerdo con el \u00e1mbito territorial que corresponda.<\/span><\/p>\n<p style=\"margin-left: 18pt; mso-list: l1 level1 lfo1; tab-stops: list 18.0pt; text-align: justify; text-indent: -18pt;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 14pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">B)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">  <\/span><\/span><\/span><\/b><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 14pt;\">VALORACI\u00d3N DE SUELO URBANIZADO EDIFICADO (Articulo 22)<\/span><\/b><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">Se aplicara <b style=\"mso-bidi-font-weight: normal;\">a la edificabilidad de referencia, y aplicando el m\u00e9todo residual est\u00e1tico<\/b>, estim\u00e1ndose el valor en venta de los productos inmobiliarios en base a un estudio de marcado y teniendo en cuenta los costes de la promoci\u00f3n, incluidos los que los gatos generales y el <b style=\"mso-bidi-font-weight: normal;\">coste de financiaci\u00f3n<\/b> de la promoci\u00f3n, por aplicaci\u00f3n de un coeficiente global de <b style=\"mso-bidi-font-weight: normal;\">1,40<\/b>, <b style=\"mso-bidi-font-weight: normal;\">que podr\u00e1 reducirse hasta un m\u00ednimo de 1,20<\/b> en caso de viviendas unifamiliares en municipios con escasa din\u00e1mica inmobiliaria, viviendas sujetas a un r\u00e9gimen de protecci\u00f3n que fije valores m\u00e1ximos de venta, naves industriales u otras edificaciones vinculadas a explotaci\u00f3n econ\u00f3micas, <b style=\"mso-bidi-font-weight: normal;\">y <span style=\"mso-tab-count: 1;\">      <\/span>aumentarse hasta un m\u00e1ximo de 1,50<\/b> en terrenos sometidos a causas <span style=\"mso-tab-count: 1;\">            <\/span>objetivas de tipolog\u00eda edificatoria, de fuerte din\u00e1mica inmobiliaria, de extraordinaria localizaci\u00f3n, de plazos previstos de comercializaci\u00f3n, de alta <span style=\"mso-tab-count: 1;\">            <\/span>calidad, etc.<br \/>\n<\/span><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><span style=\"font-family: Arial; font-size: 11pt;\">En caso de <b style=\"mso-bidi-font-weight: normal;\">parcelas pendientes de urbanizaci\u00f3n<\/b>, se descuentan del valor de repercusi\u00f3n obtenido la totalidad de gastos y costes pendientes multiplicados por la suma de la unidad mas la <span style=\"mso-spacerun: yes;\"> <\/span>tasa libre de riesgo mas la prima de riesgo: (1 + TLR + TPR), siendo:<\/span><\/p>\n<p style=\"margin-left: 18pt; text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 11pt;\">TLR = Tasa libre de riesgo<\/span><\/b><span style=\"font-family: Arial; font-size: 11pt;\">, la ultima referencia publicada por el Banco de <span style=\"mso-tab-count: 1;\">            <\/span>Espa\u00f1a del rendimiento interno en el mercado secundario de la deuda publica de plazo entre 2 y 6 a\u00f1os.<br \/>\n<\/span><\/p>\n<p style=\"margin-left: 54pt; text-align: justify; text-indent: -36pt;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: Arial; font-size: 11pt;\">PR = Prima de Riesgo, <\/span><\/b><span style=\"font-family: Arial; font-size: 11pt;\">la establecida como m\u00ednimo en la tabla siguiente, en funci\u00f3n del tipo de promoci\u00f3n inmobiliaria:<\/span><\/p>\n<table border=\"1\" cellpadding=\"0\" cellspacing=\"0\" class=\"MsoTableGrid\" style=\"border-collapse: collapse;
