El factor global de<br \/>\nlocalizaci\u00f3n, deber\u00e1 obtenerse del producto de los tres factores de correcci\u00f3n<br \/>\nque se mencionan a continuaci\u00f3n y no podr\u00e1 ser superior a dos.<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp; a) Por accesibilidad a n\u00facleos<br \/>\nde poblaci\u00f3n, u<sub>1<\/sub>.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp; b) Por accesibilidad a centros<br \/>\nde actividad econ\u00f3mica, u<sub>2<\/sub>.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp; c) Por ubicaci\u00f3n en entornos de<br \/>\nsingular valor ambiental o paisaj\u00edstico, u<sub>3<\/sub>.<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">2. En todo caso, a los efectos del<br \/>\nc\u00e1lculo del factor global de localizaci\u00f3n, cuando alguno de los tres factores<br \/>\nde correcci\u00f3n no resulte de aplicaci\u00f3n tomar\u00e1 como valor la unidad.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">3. El factor de correcci\u00f3n u<sub>1<\/sub>,<br \/>\nse calcular\u00e1 aplicando la siguiente expresi\u00f3n.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; U1 = 1 + (P1 + P2\/3)<br \/>\n\/1.000.000<span style=\"mso-spacerun: yes;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Donde:<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">P<sub>1<\/sub>= El n\u00famero de<br \/>\nhabitantes de los n\u00facleos de poblaci\u00f3n situados a menos de 4 km de distancia medida a<br \/>\nvuelo de p\u00e1jaro, entendida como la distancia en l\u00ednea recta medida sobre la<br \/>\nproyecci\u00f3n en un plano horizontal.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">P<sub>2<\/sub>= El n\u00famero de<br \/>\nhabitantes de los n\u00facleos de poblaci\u00f3n situados a m\u00e1s de 4 km y a menos de 40 km de distancia medida a<br \/>\nvuelo de p\u00e1jaro o 50 minutos de trayecto utilizando los medios habituales de<br \/>\ntransporte y en condiciones normales.<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">4. Cuando el suelo rural a<br \/>\nvalorar est\u00e9 pr\u00f3ximo a centros de comunicaciones y de transporte, por la<br \/>\nlocalizaci\u00f3n cercana a puertos de mar, aeropuertos, estaciones de ferrocarril,<br \/>\ny \u00e1reas de intermodalidad, as\u00ed como pr\u00f3ximo a grandes complejos urbanizados de<br \/>\nuso terciario, productivo o comercial relacionados con la actividad que<br \/>\ndesarrolla la explotaci\u00f3n considerada en la valoraci\u00f3n, el factor de<br \/>\ncorrecci\u00f3n, u<sub>2<\/sub>, se calcular\u00e1 de acuerdo con la siguiente expresi\u00f3n:<\/span><\/div>\n<div class=\"centroredonda1\" style=\"background: white none repeat scroll 0% 0%; text-align: justify;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; U2<sub>2<\/sub><br \/>\n= 1,6 &#8211; 0,01 . d<span style=\"mso-spacerun: yes;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Donde:<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">d = La distancia kilom\u00e9trica<br \/>\ndesde el inmueble objeto de la valoraci\u00f3n utilizando las v\u00edas de transporte<br \/>\nexistentes y considerando el trayecto m\u00e1s favorable. Esta distancia, en ning\u00fan<br \/>\ncaso, ser\u00e1 superior a 60 km.<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">5. Cuando el suelo rural a<br \/>\nvalorar est\u00e9 ubicado en entornos de singular valor ambiental o paisaj\u00edstico,<br \/>\nresultar\u00e1 de aplicaci\u00f3n el factor corrector u3, que se calcular\u00e1 de acuerdo con<br \/>\nla siguiente expresi\u00f3n:<\/span><\/div>\n<div class=\"centroredonda1\" style=\"background: white none repeat scroll 0% 0%; text-align: justify;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">&nbsp;&nbsp;&nbsp;&nbsp; U3<sub>3<\/sub><br \/>\n= 1,1 + 0,1 . (p + t)<span style=\"mso-spacerun: yes;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Donde:<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">p = coeficiente de ponderaci\u00f3n<br \/>\nseg\u00fan la calidad ambiental o paisaj\u00edstica.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">t = coeficiente de ponderaci\u00f3n<br \/>\nseg\u00fan el r\u00e9gimen de usos y actividades.<\/span><\/div>\n<div class=\"parrafo21\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">A los efectos de la aplicaci\u00f3n<br \/>\ndel factor corrector u3, se considerar\u00e1n como entornos de singular valor ambiental<br \/>\no paisaj\u00edstico aquellos terrenos que por sus valores ambientales, culturales,<br \/>\nhist\u00f3ricos, arqueol\u00f3gicos, cient\u00edficos y paisaj\u00edsticos, sean objeto de<br \/>\nprotecci\u00f3n por la legislaci\u00f3n aplicable y, en todo caso, los espacios incluidos<br \/>\nen la Red Natura<br \/>\n2000.<\/span><\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<\/div>\n<div class=\"parrafo1\" style=\"background: white none repeat scroll 0% 0%;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">El coeficiente de ponderaci\u00f3n,<br \/>\np, deber\u00e1 determinarse sobre la base de criterios objetivos de acuerdo con los<br \/>\nvalores reconocidos a los terrenos objeto de la valoraci\u00f3n en los instrumentos<br \/>\nde ordenaci\u00f3n urban\u00edstica y territorial o, en su caso, en las redes de espacios<br \/>\nprotegidos. Estar\u00e1 comprendido entre unos valores de 0 y 2, y atender\u00e1 a los<br \/>\nvalores y cualidades del entorno, siendo mayor cuanto mayor sea su calidad<br \/>\nambiental y paisaj\u00edstica o sus valores culturales, hist\u00f3ricos, arqueol\u00f3gicos y<br \/>\ncient\u00edficos.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">El coeficiente de ponderaci\u00f3n,<br \/>\nt, se aplicar\u00e1 \u00fanicamente cuando se acredite que, seg\u00fan los instrumentos de<br \/>\nordenaci\u00f3n territorial y urban\u00edstica, en los terrenos se permite un r\u00e9gimen de<br \/>\nusos y actividades diferentes a los agropecuarios o forestales que incrementan<br \/>\nel valor. Estar\u00e1 comprendido entre unos valores de 0 y 7, y atender\u00e1 a la<br \/>\ninfluencia del concreto r\u00e9gimen de usos y actividades en el incremento del<br \/>\nvalor del suelo sin consideraci\u00f3n alguna de las expectativas urban\u00edsticas,<br \/>\nsiendo mayor cuanto mayor sea tal influencia.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Es decir que estos factores<br \/>\nalteran el valor de una explotaci\u00f3n rural. \u00bfos parece l\u00f3gico?<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Si pensamos , por ejemplo en el<br \/>\nfactor de accesibilidad a n\u00facleos de poblaci\u00f3n, cre\u00e9is que esto influyen en una<br \/>\nexplotaci\u00f3n forestal, Una chopera, por ejemplo.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">En nuestra opini\u00f3n, salvo casos<br \/>\nmuy puntuales de hortalizas y frutas la cercan\u00eda a centros de consumo<br \/>\nimportantes, por el numero de habitantes puede influir, pero en otras<br \/>\nexplotaciones, en nuestra opini\u00f3n no.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Ahora bien si lo que el<br \/>\nReglamento parece primar es la cercan\u00eda a n\u00facleos importantes de poblaci\u00f3n por<br \/>\nel valor potencial en otros mercados como son los urban\u00edsticos es evidente que<br \/>\nsi. Pero si esto es la esencia del concepto el Reglamento entrara en<br \/>\ncontradicci\u00f3n, primando valores potenciales que manifiestamente rechaza<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Nuestra opini\u00f3n es pues, que en<br \/>\nel incremento debe seleccionarse, si acaso,<span style=\"mso-spacerun: yes;\">&nbsp;<br \/>\n<\/span>por el tipo de explotaci\u00f3n.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">La segunda critica a la formula<br \/>\nes la lecci\u00f3n del radio de aproximaci\u00f3n &lt; 4 Km y mas de 40 Km., cuando estos<br \/>\npar\u00e1metros dependen mas, l\u00f3gicamente del tipo de poblaci\u00f3n, ya que para algunas<br \/>\nciudades como Madrid o Barcelona estos radios pueden no tener sentido para<br \/>\notras ciudades mas peque\u00f1as como pueden ser Soria o \u00c1vila, resultan tambi\u00e9n<br \/>\ninadecuados.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Las criticas pod\u00edan seguir con<br \/>\ntemas tan aleatorios y faltos de fundamento como el par\u00e1metro 2\/3 de la formula<br \/>\nde accesibilidad o los criterios de revalorizaci\u00f3n por entornos paisaj\u00edsticos<br \/>\nde inter\u00e9s, etc.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">No obstante, a los estrictos<br \/>\nefectos valorativos es un respiro, pues podr\u00eda hasta duplicarse (y porque no triplicarse<br \/>\no cuadriplicarse ) la valoraci\u00f3n de un suelo rural por aplicaci\u00f3n de estos<br \/>\ncriterios.<\/span><\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<\/div>\n<div class=\"parrafo21\" style=\"text-indent: 0cm;\">\n<span face=\"&quot;Arial&quot;,&quot;sans-serif&quot;\" style=\"color: #333333; font-size: 11pt;\">Dejando aparte estas ventajas pr\u00e1cticas<br \/>\npodr\u00edais aportar algunos criterios al respecto.<\/span><\/div>\n","protected":false},"excerpt":{"rendered":"<p>El nuevo Reglamento de Valoraciones de la Ley del Suelo aprobado por el RD 1492\/2011, contempla, a la hora de valorar suelo, que el valor de un suelo rural vendr\u00e1\u2026 <a class=\"continue-reading-link\" href=\"https:\/\/prayde.com\/empresa\/extranas-formulas-de-incremento-de\/\">Continue leyendo<\/a><\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[19,33,29],"class_list":["post-1838","post","type-post","status-publish","format-standard","hentry","category-sin-categoria","tag-legislacion","tag-opinion","tag-suelo"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
