justify;\">\n<span style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Repasemos alguna de ellas, para lo que<br \/>\naclaramos algunos conceptos:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: black; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">1) <b style=\"mso-bidi-font-weight: normal;\">Aprovechamiento objetivo<\/b><br \/>\n(o aprovechamiento real): es la cantidad de <b style=\"mso-bidi-font-weight: normal;\">metros cuadrados<\/b> de construcci\u00f3n o <b style=\"mso-bidi-font-weight: normal;\">edificaci\u00f3n<\/b> <b style=\"mso-bidi-font-weight: normal;\">no destinada a<br \/>\ndotaciones p\u00fablicas<\/b>, <b style=\"mso-bidi-font-weight: normal;\">ponderados<\/b> <b style=\"mso-bidi-font-weight: normal;\">en funci\u00f3n de los diferentes<\/b> valores de<br \/>\nrepercusi\u00f3n del suelo de los <b style=\"mso-bidi-font-weight: normal;\">usos<\/b><br \/>\ncomprendidos en la correspondiente \u00e1rea de reparto en su caso, cuya<br \/>\nmaterializaci\u00f3n permite o exige el planeamiento en un solar, una parcela o una<br \/>\nunidad r\u00fastica apta para la edificaci\u00f3n.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: black; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">2) <b style=\"mso-bidi-font-weight: normal;\">Aprovechamiento medio<\/b>:<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">es la edificabilidad unitaria<\/b><br \/>\nponderada en funci\u00f3n de los diferentes valores de repercusi\u00f3n del suelo de los<br \/>\nusos comprendidos en la correspondiente \u00e1rea de reparto, que el planeamiento<br \/>\nestablece para todos los terrenos comprendidos en una misma \u00e1rea de reparto o<br \/>\n\u00e1mbito espacial de referencia, determin\u00e1ndose <b style=\"mso-bidi-font-weight: normal;\">mediante la divisi\u00f3n del aprovechamiento objetivo<\/b> total atribuido<br \/>\nal \u00e1rea de reparto <b style=\"mso-bidi-font-weight: normal;\">por la superficie<\/b><br \/>\nde la misma, descontando<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>la superficie<br \/>\nde suelo dotacional p\u00fablico existente ya afectado a su destino.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">3)<br \/>\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: black;\">Aprovechamiento<br \/>\nsubjetivo<\/span><\/b><span style=\"color: black;\"> (o aprovechamiento susceptible<br \/>\nde patrimonializaci\u00f3n): la cantidad de metros cuadrados construibles o<br \/>\nedificables ponderados en funci\u00f3n de los diferentes valores de repercusi\u00f3n del<br \/>\nsuelo de los usos comprendidos en la correspondiente \u00e1rea de reparto, que<br \/>\nexpresa el <b style=\"mso-bidi-font-weight: normal;\">contenido urban\u00edstico<br \/>\nlucrativo a que tiene derecho el propietario<\/b> de un solar, una parcela o una<br \/>\nunidad r\u00fastica apta para la edificaci\u00f3n, cumpliendo los deberes y levantando<br \/>\nlas cargas legales, as\u00ed como sufragando el coste de las obras de urbanizaci\u00f3n<br \/>\nque correspondan. <\/span><span style=\"color: red;\"><\/span><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Pues<br \/>\nbien, en este contexto se define el <b style=\"mso-bidi-font-weight: normal;\">EXCEDENTE<br \/>\nDE APROVECHAMIENTO, como la diferencia positiva que resulta al restar del<br \/>\naprovechamiento objetivo el aprovechamiento subjetivo.<\/b> Este excedente puede<br \/>\nestar integrado por dos componentes:<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"margin-left: 38.25pt; objetivo y el medio del \u00e1rea de reparto.<\/b> Este<br \/>\nsegundo componente tendr\u00e1 por destino, en su caso, la compensaci\u00f3n a<br \/>\npropietarios de suelo de la misma \u00e1rea de reparto cuyo aprovechamiento objetivo<br \/>\nsea inferior al aprovechamiento medio de \u00e9sta.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Es<br \/>\ndecir, pueden existir <span style=\"color: black;\">sectores cuyo aprovechamiento<br \/>\nsea superior o inferior a la media aritm\u00e9tica de los aprovechamientos medios<br \/>\ncorrespondientes a la totalidad de las \u00e1reas de reparto en que el planeamiento<br \/>\nhubiera desagregado el suelo urbanizable. <b style=\"mso-bidi-font-weight: normal;\">El<br \/>\nplaneamiento podr\u00e1 incrementar o disminuir la entrega de suelo urbanizable con<br \/>\naprovechamiento lucrativo, seg\u00fan proceda, en proporci\u00f3n a la diferencia<br \/>\nexistente y hasta un m\u00e1ximo de un 15% y un m\u00ednimo de un 5%.<\/b><\/span><\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: black; font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Tambi\u00e9n <b style=\"mso-bidi-font-weight: normal;\">deber\u00e1 entregarse a<br \/>\nla administraci\u00f3n la superficie de suelo con aprovechamiento lucrativo que<br \/>\ncorresponda<\/b>, en su caso, al porcentaje pertinente aplicado a la diferencia<br \/>\nentre el aprovechamiento del sector y el aprovechamiento medio del \u00e1rea de<br \/>\nreparto. Esta entrega se realizar\u00e1 con car\u00e1cter provisional y a reserva de<br \/>\nliquidaci\u00f3n final, cuando este componente del excedente de aprovechamiento deba<br \/>\ndestinarse a la compensaci\u00f3n de propietarios de terrenos cuyo aprovechamiento<br \/>\nobjetivo sea inferior al medio del \u00e1rea de reparto.
