font-size: 11pt;\">En el concepto de obras de urbanizaci\u00f3n se deben distinguir<br \/>\nlos siguientes t\u00e9rminos:<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\">\n<!--[if !supportLists]--><span style=\"font-family: Arial; font-size: 11pt;\"><span>A)<span style=\"font-family: &quot;Times New Roman&quot;; font-size-adjust: none; font-size: 7pt; font-stretch: normal; font-style: normal; font-variant: normal; font-weight: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><!--[endif]--><span style=\"font-family: Arial; font-size: 11pt;\">Obras<br \/>\nde Urbanizaci\u00f3n Exterior<o:p><\/o:p><\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">Son las obras que el urbanismos<br \/>\nexige realizar a los propietarios de un \u00e1mbito urban\u00edstico de actuaci\u00f3n para<br \/>\ntransformarlo los terrenos incluidos en dicho \u00e1mbito en solares edificables,<br \/>\npor un lado, y por otro que el Ayuntamiento se adjudique los viales, parques, jardines<br \/>\ny dem\u00e1s dotaciones publicas en las correspondientes parcelas en donde se ubican<br \/>\nlos equipamientos p\u00fablicos, todo ello tal y como figura en el correspondiente<br \/>\nproyecto de urbanizaci\u00f3n, que es uno de los documentos que se deben aprobar y<br \/>\ntramitar en la ejecuci\u00f3n del planeamiento, por los particulares de los terrenos<br \/>\nconstituidos o no en Junta de Compensaci\u00f3n, Agente Urbanizador Privado, etc.<o:p><\/o:p><\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">En este proyecto se incluyen cap\u00edtulos<br \/>\ncomo:<o:p><\/o:p><\/span><\/div>\n<div style=\"margin-left: 18pt; font-size: 11pt;\">Amueblamiento<br \/>\npublico<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">El proyecto de urbanizaci\u00f3n desarrolla las previsiones<br \/>\nestablecidas en el planeamiento general e incluye, adem\u00e1s las obras de conexi\u00f3n<br \/>\nde estas redes con las generales del municipio. En general, estas obras de<br \/>\nconexi\u00f3n se realizan fuera de los terrenos incluidos en el \u00e1mbito de actuaci\u00f3n<br \/>\ny, por tanto necesitan para su ejecuci\u00f3n de los correspondientes permisos o<br \/>\nautorizaciones, que deben facilitar los Ayuntamientos,<span>&nbsp; <\/span>pertinentes para ocupar con dichas obras<br \/>\nterrenos de propiedad ajena.<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">Estas obras de conexi\u00f3n tambi\u00e9n pueden venir impuestas en<br \/>\nlos PGOU como porcentaje de participaci\u00f3n del \u00e1mbito, en las obras de<br \/>\nampliaci\u00f3n de servicios que deban realizar el Ayuntamiento o las Compa\u00f1\u00edas<br \/>\nSuministradoras al efecto (Ampliaci\u00f3n del Deposito Municipal de Aguas,<br \/>\nAmpliaci\u00f3n o construcci\u00f3n de una nueva Depuradora, Ejecuci\u00f3n de una nueva L\u00ednea<br \/>\nEl\u00e9ctrica de Alta tensi\u00f3n, Accesos a Viales por Superficie, por Puentes o T\u00faneles,<br \/>\netc.).<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">El proyecto de Urbanizaci\u00f3n establecido en el tramite urban\u00edstico<br \/>\ncorrespondiente no devenga ICIO, ni generalmente Tasa Urban\u00edstica, salvo que,<br \/>\nen algunos municipios tienen aprobada una tasa que aplican a estos proyectos, a<br \/>\nnuestro entender ilegalmente, ya que la tasa se aplica por los servicios<br \/>\nprestados a una determinada persona, que se beneficia directamente de estos<br \/>\nservicios, pero este no es el caso, ya que la ejecuci\u00f3n de un proyecto de<br \/>\nurbanizaci\u00f3n beneficia al inter\u00e9s general del municipio, que gracias al mismo y<br \/>\na su correspondiente ejecuci\u00f3n recibe, de forma gratuita, los viales, parques y<br \/>\njardines y parcelas para el equipamiento publico, totalmente urbanizadas.<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\">\n<!--[if !supportLists]--><span style=\"font-family: Arial; font-size: 11pt;\"><span>B)<span style=\"font-family: &quot;Times New Roman&quot;; font-size-adjust: none; font-size: 7pt; font-stretch: normal; font-style: normal; font-variant: normal; font-weight: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><!--[endif]--><span style=\"font-family: Arial; font-size: 11pt;\">Obras<br \/>\nde Urbanizaci\u00f3n Interior<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">Son las necesarias para la urbanizaci\u00f3n interior de cada<br \/>\nparcela edificable y, generalmente, se incluyen en los proyectos de edificaci\u00f3n<br \/>\nde estas.<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">En estas obras de urbanizaci\u00f3n interior, cada parcela tiene<br \/>\nresueltos los viales perimetrales y los puntos de conexi\u00f3n de los diferentes<br \/>\nservicios, pero ahora se trata de acceder a cada bloque de edificaci\u00f3n. <o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">As\u00ed pues la primera diferencia fundamental, entre unas y<br \/>\notras, es la temporalidad en su ejecuci\u00f3n:<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\">\n<!--[if !supportLists]--><span style=\"font-family: Arial; font-size: 11pt;\"><span>1)<span style=\"font-family: &quot;Times New Roman&quot;; font-size-adjust: none; font-size: 7pt; font-stretch: normal; font-style: normal; font-variant: normal; font-weight: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><!--[endif]--><span style=\"font-family: Arial; font-size: 11pt;\">Las<br \/>\nobras de urbanizaci\u00f3n exterior y sus conexiones deben realizarse con<br \/>\nanterioridad a <st1:personname productid=\"la edificaci\ufff3n. Algunos Ayuntamientos\" w:st=\"on\">la edificaci\u00f3n. Algunos Ayuntamientos<\/st1:personname> permite<br \/>\nsimultanear la ejecuci\u00f3n de dichas obras de urbanizaci\u00f3n con la edificaci\u00f3n,<br \/>\npero debe avalarse el importe pendiente de ejecuci\u00f3n o un porcentaje de este, y<br \/>\nlas edificaciones simultaneadas, tienen condicionada la licencia de primera<br \/>\nocupaci\u00f3n a la ejecuci\u00f3n total de la urbanizaci\u00f3n.<o:p><\/o:p><\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36pt; text-align: justify; text-indent: -18pt;\">\n<!--[if !supportLists]--><span style=\"font-family: Arial; font-size: 11pt;\"><span>2)<span style=\"font-family: &quot;Times New Roman&quot;; font-size-adjust: none; font-size: 7pt; font-stretch: normal; font-style: normal; font-variant: normal; font-weight: normal; line-height: normal;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><!--[endif]--><span style=\"font-family: Arial; font-size: 11pt;\">Las<br \/>\nobras de Urbanizaci\u00f3n Interior se realizan, generalmente, unos meses antes de<br \/>\nla previsi\u00f3n de la fecha de terminaci\u00f3n y entrega de la edificaci\u00f3n, de forma<br \/>\nque est\u00e9n terminadas simult\u00e1neamente con aquellas. adem\u00e1s incluyen los<br \/>\nelementos l\u00fadicos que el promotor puede o no incluir en esos espacios<br \/>\ninteriores: jardines, piscina, tenis, padel, etc., que l\u00f3gicamente ser\u00e1n<br \/>\nelementos de tipo comercial que pueden influir de forma directa es tener mas o<br \/>\nmenos facilidades de venta.<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">Otra diferencia importante es el coste de unas obras y<br \/>\notras, evidentemente las primeras muy superiores a las segundas, pero llegamos<br \/>\naqu\u00ed, al asunto mas importante, como se puede estimar el coste de unas y otras.<o:p><\/o:p><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: Arial; font-size: 11pt;\">Evidentemente no existe una formula general para realizar<br \/>\nuna estimaci\u00f3n de cada una de ellas, suprimiendo las que dependen directamente<br \/>\nde la voluntad comercializadora del promotor.
