IMPULSO A LA IMPLANTACION DE<br \/>\nACTUACIONES TERRITORIALES ESTRATEGICAS, y ahora retomando el tema del<br \/>\nincumplimiento de los plazos legales m\u00e1ximos que modifica el contenido de la Ley 16\/2005<i><span style=\"color: black;\">, <\/span><\/i><span style=\"color: black; mso-bidi-font-style: italic;\">de 30 de diciembre, de la Generalitat, urban\u00edstica valenciana<i>.<\/i><\/span><span style=\"color: black;\"><\/span><\/div>\n<div class=\"Pa17\" style=\"margin-bottom: 8.0pt; margin-left: 17.0pt; margin-right: 0cm; margin-top: 8.0pt; text-align: justify; text-indent: -17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">\u00abArt\u00edculo 187 bis. <i>Expropiaci\u00f3n<br \/>\nde suelos rotacionales por incumplimiento de plazo.<\/i><\/span><\/div>\n<div class=\"Pa16\" style=\"margin-left: 28.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">1. <b style=\"mso-bidi-font-weight: normal;\">Cuando transcurran cinco a\u00f1os<\/b> desde la entrada en vigor del plan <b style=\"mso-bidi-font-weight: normal;\">sin que se llevase a efecto la expropiaci\u00f3n<br \/>\n<\/b>de terrenos dotacionales que no hayan de ser objeto de cesi\u00f3n obligatoria,<br \/>\npor no resultar posible la justa distribuci\u00f3n de beneficios y cargas en el<br \/>\ncorrespondiente \u00e1mbito de actuaci\u00f3n, <b style=\"mso-bidi-font-weight: normal;\">los<br \/>\npropietarios podr\u00e1n anunciar al ayuntamiento su prop\u00f3sito de iniciar el<br \/>\nexpediente de justiprecio<\/b>, que debe llevarse a cabo por ministerio de la<br \/>\nley si transcurren otros dos a\u00f1os desde dicho anuncio.<\/span><\/div>\n<div class=\"Pa16\" style=\"margin-left: 28.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">2.<br \/>\n A<\/span><span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\"><br \/>\ntal efecto, <b style=\"mso-bidi-font-weight: normal;\">los propietarios podr\u00e1n<br \/>\npresentar sus hojas de aprecio<\/b> y, transcurridos tres meses sin que el<br \/>\nayuntamiento notifique su aceptaci\u00f3n o remita sus hojas de aprecio<br \/>\ncontradictorias, los propietarios podr\u00e1n <b style=\"mso-bidi-font-weight: normal;\">dirigirse<br \/>\nal jurado provincial de expropiaci\u00f3n forzosa.<\/b> La valoraci\u00f3n se entender\u00e1<br \/>\nreferida al momento del inicio del expediente de justiprecio por ministerio de<br \/>\nla ley.<\/span><\/div>\n<div class=\"Default\">\n<\/div>\n<div class=\"Pa16\" style=\"margin-left: 28.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">3. Lo establecido en los<br \/>\napartados anteriores <b style=\"mso-bidi-font-weight: normal;\">no ser\u00e1 aplicable<\/b>:<\/span><\/div>\n<div class=\"Pa15\" style=\"margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 28.0pt; margin-right: 0cm; margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">a) A los propietarios de terrenos<br \/>\nclasificados como <b style=\"mso-bidi-font-weight: normal;\">suelo no urbanizable<\/b>.<\/span><\/div>\n<div class=\"Pa16\" style=\"margin-left: 28.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">b) A los propietarios de terrenos<br \/>\nclasificados como <b style=\"mso-bidi-font-weight: normal;\">suelo urbanizable, si<br \/>\nen el momento de la afectaci\u00f3n los terrenos se dedican a la explotaci\u00f3n<\/b><br \/>\nagr\u00edcola, ganadera, forestal o cineg\u00e9tica o, en general, a actividades propias<br \/>\nde su naturaleza r\u00fastica y compatibles con la clasificaci\u00f3n y la afectaci\u00f3n<br \/>\nmencionadas hasta la ejecuci\u00f3n de las determinaciones del planeamiento<br \/>\nurban\u00edstico.<\/span><\/div>\n<div class=\"Pa16\" style=\"margin-left: 28.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">c) <b style=\"mso-bidi-font-weight: normal;\">A los propietarios que hayan obtenido una autorizaci\u00f3n para usos y<br \/>\nobras provisionales<\/b>.<\/span><\/div>\n<div class=\"Pa15\" style=\"margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 28.0pt; margin-right: 0cm; margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">4. <b style=\"mso-bidi-font-weight: normal;\">Si antes de transcurrir los plazos<\/b> establecidos en este precepto <b style=\"mso-bidi-font-weight: normal;\">se ha aprobado inicialmente una<br \/>\nmodificaci\u00f3n o una revisi\u00f3n del planeamiento<\/b> urban\u00edstico que comporta la<br \/>\ninclusi\u00f3n del suelo dotacional en un sector o unidad de ejecuci\u00f3n al efecto de<br \/>\nsu gesti\u00f3n, <b style=\"mso-bidi-font-weight: normal;\">dichos plazos quedar\u00e1n<br \/>\ninterrumpidos<\/b>. El c\u00f3mputo de los plazos se reanudar\u00e1 si transcurre un a\u00f1o<br \/>\nsin haberse producido su aprobaci\u00f3n definitiva.\u00bb<\/span><\/div>\n<div class=\"Pa8\" style=\"margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">Ocho. El apartado 1 del art\u00edculo<br \/>\n189 queda redactado del siguiente modo:<\/span><\/div>\n<div class=\"Pa15\" style=\"margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 28.0pt; margin-right: 0cm; margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">\u00ab1. Cuando razones t\u00e9cnicas<br \/>\nespeciales hagan imprescindible diferir o anticipar la implantaci\u00f3n de<br \/>\ninfraestructuras complementarias respecto a la total urbanizaci\u00f3n de los<br \/>\nsolares, las ordenanzas municipales podr\u00e1n establecer un canon de urbanizaci\u00f3n<br \/>\npara que los peticionarios de licencias o los propietarios de parcelas y<br \/>\nadjudicatarios de programas contribuyan a sufragar aquellas infraestructuras.<br \/>\nEl canon s\u00f3lo podr\u00e1 exigirse una vez que se hayan iniciado las obras de<br \/>\nurbanizaci\u00f3n.\u00bb<\/span><\/div>\n<div class=\"Pa8\" style=\"margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">Nueve. El apartado 1 del art\u00edculo<br \/>\n261 queda redactado del siguiente modo:<\/span><\/div>\n<div class=\"Pa15\" style=\"margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 28.0pt; margin-right: 0cm; margin-top: 8.0pt; text-align: justify; text-indent: 17.0pt;\">\n<span style=\"font-family: &quot;Times New Roman&quot;,&quot;serif&quot;;\">\u00ab1. Las administraciones<br \/>\np\u00fablicas, en previsi\u00f3n de la ampliaci\u00f3n de sus patrimonios p\u00fablicos de suelo,<br \/>\npodr\u00e1n establecer \u00e1reas reservadas de terrenos, cualquiera que sea su<br \/>\nclasificaci\u00f3n o calificaci\u00f3n urban\u00edstica. La reserva, si no estuviera prevista<br \/>\nen el plan general o fuera insuficiente, se efectuar\u00e1 mediante plan especial y<br \/>\npodr\u00e1 ser incluso previa a la programaci\u00f3n de los terrenos. Dicha programaci\u00f3n,<br \/>\nno obstante, podr\u00e1 ser instada por los particulares, conforme al art\u00edculo 130,<br \/>\ndebiendo solicitar autorizaci\u00f3n previa a la administraci\u00f3n titular de la<br \/>\nreserva, quien, en su caso, podr\u00e1 otorgarla con sujeci\u00f3n a las condiciones de<br \/>\ninter\u00e9s p\u00fablico que procedan para lograr los fines sociales a los que se<br \/>\nadscriba.
