justify;\">&nbsp;<\/div>\n<div style=\"text-align: justify;\">En la entrega IV de las leyes<br \/>\nAuton\u00f3micas de Suelo nos planteamos la incidencia de los par\u00e1metros urban\u00edsticos<br \/>\nfundamentales en <b style=\"mso-bidi-font-weight: normal;\">el ajuste a valores<br \/>\nrazonables del valor de K que haga posible que la iniciativa privada se vuelva<br \/>\na incorporar como motor principal del urbanismo<\/b> que como dice la ley del<br \/>\nsuelo estatal vigente sea capaz de desarrollar el suelo necesario para lograra<br \/>\nun desarrollo urbano sostenible y SOLO ESE SUELO. Es un modelo que podemos estar<br \/>\no no de acuerdo con el, podemos considerar que existen modelos mejores o no,<br \/>\npero en definitiva es el que hay y en el que las empresas inmobiliarias deben<br \/>\nmoverse, como tradicionalmente han hecho con cualquier otro modelo que con<br \/>\nanterioridad hubiera estado vigente.<\/div>\n<div style=\"text-align: justify;\">&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n<div class=\"separator\" style=\"clear: both; text-align: center;\"><a href=\"https:\/\/1.bp.blogspot.com\/-nu6WQ_PMJXA\/Xv2d4lXo7lI\/AAAAAAAAAlo\/9wn4Sba58VAea4izROz2ttG3LVB8PgklgCPcBGAYYCw\/s283\/FondodeParcela.jpg\" imageanchor=\"1\" style=\"margin-left: 1em; margin-right: 1em;\"><img decoding=\"async\" border=\"0\" data-original-height=\"207\" data-original-width=\"283\" src=\"https:\/\/1.bp.blogspot.com\/-nu6WQ_PMJXA\/Xv2d4lXo7lI\/AAAAAAAAAlo\/9wn4Sba58VAea4izROz2ttG3LVB8PgklgCPcBGAYYCw\/s0\/FondodeParcela.jpg\" \/><\/a><\/div>\n<p>&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEs un hecho totalmente<br \/>\nconstatable que siempre ha sido as\u00ed, ya que la empresa privada tiene como<br \/>\nobjetivo claro obtener la m\u00e1xima rentabilidad posible para sus accionistas de<br \/>\nlas inversiones que realiza y, estas siempre se realizan de acuerdo con la<br \/>\nlegalidad vigente.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nCuestion\u00e1bamos <b style=\"mso-bidi-font-weight: normal;\">si la administraci\u00f3n es consciente de que<br \/>\ndebe ajustar el modelo para conseguir que la K sea interesante<\/b> y compense de riesgos<br \/>\ninherentes a toda inversi\u00f3n m\u00e1xime cuando las del tipo inmobiliario tiene como caracter\u00edsticas<br \/>\nsu <b style=\"mso-bidi-font-weight: normal;\">elevado periodo de maduraci\u00f3n, su<br \/>\nalto riesgo y su poca liquidez.<\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEvidentemente <b style=\"mso-bidi-font-weight: normal;\">un primer ajuste se produciria si rebajamos<br \/>\nlos par\u00e1metros urban\u00edsticos fundamentales:<\/b> cesi\u00f3n de suelo, cesi\u00f3n de<br \/>\naprovechamiento y reserva de suelo para construir VPP.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nPero <b style=\"mso-bidi-font-weight: normal;\">existen otros par\u00e1metros<\/b> cuya modificaci\u00f3n es mas sutil y que<br \/>\nalgunos de ellos pueden ser el origen des desajustes.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEn el texto que sigue vamos a<br \/>\nanalizar algunos de ellos, poniendo de manifiesto que su <b style=\"mso-bidi-font-weight: normal;\">fuerte contenido econ\u00f3mico<\/b> exige reflexionar sobre su implantaci\u00f3n<br \/>\ncontemplando su ajuste con otros considerandos t\u00e9cnicos o sociales de indudable<br \/>\nimportancia pero impidiendo que unos primen sobre otros sin otra consideraci\u00f3n.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; mso-list: l1 level1 lfo1; tab-stops: list 18.0pt; text-align: justify; text-indent: -18pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><b style=\"mso-bidi-font-weight: normal;\">\u00cdndice de edificabilidad<\/b><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\nSe observa <b style=\"mso-bidi-font-weight: normal;\">el empleo generalizado de \u00edndices de edificabilidad<br \/>\nbajos<\/b> 0,20 \u2013 0,30 m2 edificables \/ m2 de suelo que <b style=\"mso-bidi-font-weight: normal;\">en muchos casos no son compatibles con ciertas ubicaciones de niveles<br \/>\nsociales de bajo perfil econ\u00f3mico<\/b>. La superficie \u00fatil m\u00e1xima de las viviendas de VPP es de 90 m2 \u00fatiles y se supone que<br \/>\nen el proyecto vamos a obtener una relaci\u00f3n m2 \u00fatil\/m2 construido con zonas<br text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nAparentemente su actuaci\u00f3n no<br \/>\nsupone ning\u00fan efecto econ\u00f3mico, pero el promotor inmobiliario mas pegado al<br \/>\nmercado puede considerar que <b style=\"mso-bidi-font-weight: normal;\">la<br \/>\nsuperficie media de las viviendas libres, 168 m2 construidos<\/b> (que es su<br \/>\npar\u00e1metro de venta) <b style=\"mso-bidi-font-weight: normal;\">es muy superior a la<br \/>\nsuperficie unitaria media que el mercado considera comercialmente id\u00f3nea<\/b><br \/>\npara su venta (el efecto es mas pronunciado en \u00e9pocas como las actuales de<br \/>\ncrisis en las que la superficie unitaria tiende a disminuir sustancialmente) y,<br \/>\npor tanto<span style=\"mso-spacerun: yes;\">&nbsp; Y, en estos<br \/>\nmomentos de crisis son factores muy a tener en cuenta si queremos, como venimos<br \/>\ninsistiendo poder optar por la colaboraci\u00f3n de la iniciativa privada.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEn este an\u00e1lisis tan simple<br \/>\naparece un primer problema ideol\u00f3gico de fuerte calado social que es el del<br \/>\nfomento de la <b style=\"mso-bidi-font-weight: normal;\">cohesi\u00f3n social<\/b>, que<br \/>\nse incardina en dos preguntas clave:<\/div>\n<div style=\"margin-left: 36pt; mso-list: l4 level1 lfo5; tab-stops: list 36.0pt; text-align: justify; text-indent: -18pt;\">\n<span style=\"mso-list: Ignore;\">1)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span>\u00bf<b style=\"mso-bidi-font-weight: normal;\">Es bueno<br \/>\nmezclar<\/b> en un mismo sector urban\u00edstico <b style=\"mso-bidi-font-weight: normal;\">VPP<br \/>\ncon Libres<\/b>?<\/div>\n<div style=\"margin-left: 36pt; mso-list: l4 level1 lfo5; tab-stops: list 36.0pt; text-align: justify; text-indent: -18pt;\">\n<span style=\"mso-list: Ignore;\">2)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span>\u00bfEs bueno mezclar en un mismo sector urban\u00edstico <b style=\"mso-bidi-font-weight: normal;\">viviendas de poca superficie unitaria con<br \/>\nviviendas de much<\/b>a superficie unitaria?<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEn nuestra opini\u00f3n <b style=\"mso-bidi-font-weight: normal;\">la primera pregunta tiene una contestaci\u00f3n<br \/>\npositiva<\/b>, la idea de creaci\u00f3n de guetos habr\u00eda que desterrarla, y sentido<br \/>\nse pronuncia con claridad la propia administraci\u00f3n, permitiendo no solo<br \/>\nporcentajes de VPP en un mismo sector, como opini\u00f3n generalizada y no tan<br \/>\ngeneralizada llegando incluso a permitir como sucede en algunas CCAA la mezcla<br \/>\nde ambas tipolog\u00edas en un mismo bloque.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">La segunda pregunta es de contestaci\u00f3n afirmativa hasta un cierto punto<br \/>\no limite de la diferencia<\/b>, que queda justificada por familias<br \/>\nmonoparentales frente a familias numerosas, pero a partir de ese l\u00edmite la<br \/>\ncohesi\u00f3n social puede resquebrajarse y, en este sentido algunas CCCAA<br \/>\nestablecen una cierta proporci\u00f3n entre ambas superficies estableciendo as\u00ed, de<br \/>\nuna forma sencilla un cierto par\u00e1metro de coherencia. <\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nSi, en el ejemplo que estamos<br \/>\nmanejando, as\u00ed estuviera establecido en el PGOU, y, por ejemplo el factor de<br \/>\ncohesi\u00f3n social fuera de 1,25, significar\u00eda que la m\u00e1xima superficie de<br \/>\nvivienda libre que se podr\u00eda edificar seria de 120 x 1,25 = 150 mm2 y la<br \/>\nintroducci\u00f3n del porcentaje de VPP representar\u00eda una perdida de edificabilidad<br \/>\nde solo (150 \u2013 120) x 125 =<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>3.750 m2 siempre que el<br \/>\nmercado, l\u00f3gicamente admitiera esa superficie como comercialmente viable.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEn resumen la introducci\u00f3n del<br \/>\nporcentaje m\u00ednimo de reserva para construir VPP en sectores urban\u00edsticos con un<br \/>\nnumero m\u00e1ximo de viviendas, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>puede<br \/>\ncontiene un evidente perjuicio econ\u00f3mico para los propietarios que no es justo<br \/>\nque solo estos soporten<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; mso-list: l1 level1 lfo1; tab-stops: list 18.0pt; text-align: justify; text-indent: -18pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-list: Ignore;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><\/span><\/b><b style=\"mso-bidi-font-weight: normal;\">Tipologia edificatoria <\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">Otro aspecto que no se suele tomar en consideraci\u00f3n es la repercusi\u00f3n econ\u00f3mica<br \/>\nque tiene exigir una determinada tipologia edificatoria <\/b>que, a veces esta<br \/>\njustificada por razones elementales de coherencia urban\u00edstica, como sucede en<br \/>\nel caso de una tipologia de chales unifamiliares aislados, en la que no seria l\u00f3gico<br \/>\nimplantar una tipologia en altura: planta baja mas cuatro alturas mas planta de<br \/>\n\u00e1tico, pero otras veces sin ninguna otro an\u00e1lisis de las repercusiones econ\u00f3micas<br \/>\nque pueden suponer se establece, como en el caso de la <b style=\"mso-bidi-font-weight: normal;\">Comunidad<\/b><b style=\"mso-bidi-font-weight: normal;\"> de Madrid, una tipologia general de planta<br \/>\nbaja mas tres alturas (para todo el territorio<\/b> salvo casos especiales que<br \/>\nrequieren justificaci\u00f3n motivada). <\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">Generalizar<\/b> esta tipologia supone las siguientes consecuencias:<\/div>\n<div style=\"margin-left: 39.75pt; Es evidente que cada una tiene sus detractores y sus<br \/>\ndefensores a ultranza, pero lo que <b style=\"mso-bidi-font-weight: normal;\">es<br \/>\nevidente, en nuestro criterio que soluciones generalistas de uno u otro tipo no<br \/>\nson validas<\/b>. En cada momento deben evaluarse sus puntos fuertes y d\u00e9biles,<br \/>\nteniendo en cuenta los costes de urbanizaci\u00f3n y el consumo de suelo que cada<br \/>\ntipologia produce buscando, en cada caso un equilibrio que respete los intereses<br \/>\nde los promotores, usuarios y administraci\u00f3n.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">Puede ser<\/b> que <b style=\"mso-bidi-font-weight: normal;\">una tipologia<br \/>\nde baja altura<\/b> (y todav\u00eda mejor si es de baja densidad) <b style=\"mso-bidi-font-weight: normal;\">provea de mejor calidad de vida<\/b> a sus<br \/>\nusuarios, lo que no siempre es evidente, pero:<\/div>\n<div style=\"margin-left: 35.4pt; text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-spacerun: yes;\">&nbsp;<\/span>\u00bfes<br \/>\nviable econ\u00f3micamente?, <\/b><\/div>\n<div style=\"margin-left: 35.4pt; text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">\u00bfel pais se lo puede permitir?. <\/b><\/div>\n<div style=\"text-align: justify;\">\nPorque existen tambi\u00e9n soluciones<br \/>\nde alturas intermedias (el exceso de altura grava exponencialmente el coste de edificaci\u00f3n)<br \/>\nque tienen tambi\u00e9n calidad razonable.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nEn resumen<b style=\"mso-bidi-font-weight: normal;\">, no pretendemos en este breve resumen encontrar soluciones<br \/>\ngeneralistas<\/b>, de las que huimos, pues casi nunca son soluci\u00f3n, pero si es<br \/>\nevidente, que <b style=\"mso-bidi-font-weight: normal;\">debemos encontrar vias de<br \/>\ncomunicaci\u00f3n entre el urbanismo y sus posibilidades econ\u00f3micas<span style=\"mso-spacerun: yes;\">&nbsp;
