<\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 11.0pt;\">La necesidad<br \/>\nimperiosa de suelo para construir VPP<\/span><\/b><span style=\"font-size: 11.0pt;\"><br \/>\nde las que tiene un fuerte volumen de demanda, aparentemente solvente, seg\u00fan<br \/>\nestudios elaborados al respecto junto con entidades financieras dispuestas a facilitar<br \/>\nfinanciaci\u00f3n (aspecto es te que pocos ayuntamientos han realizado), por lo que<br \/>\ncualquier elevaci\u00f3n de la edificabilidad supondr\u00eda elevar el porcentaje de<br \/>\nreserva de VPP hasta el 60 %<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">A<br \/>\nestos dos aspectos se une la consideraci\u00f3n, puramente estrat\u00e9gica, de que <b style=\"mso-bidi-font-weight: normal;\">el Ayuntamiento prefiere que la operaci\u00f3n<br \/>\nse ejecute v\u00eda Agente Urbanizador Privado en la que llegar\u00eda a admitir una<br \/>\necuaci\u00f3n de canje del orden del 50 %<\/b> (las ecuaciones de canje que ese estaban<br \/>\nmanejando en la zona all\u00e1 por el a\u00f1o 2007 eran del 50%.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">Con<br \/>\nestos nuevos criterios la <b style=\"mso-bidi-font-weight: normal;\">nueva<br \/>\npropuesta<\/b> tendria como par\u00e1metros fundamentales los siguientes:<\/span><\/div>\n<div style=\"margin-left: 38.25pt; Urbanizador fuera el propio Ayuntamiento<br \/>\nque obtendr\u00eda la financiaci\u00f3n necesaria para efectuar la operaci\u00f3n con la venta<br \/>\nde los terrenos que se le adjudicaran a trav\u00e9s de la ecuaci\u00f3n de canje u otros<br \/>\nplanteamientos similares, todas las alternativas tendr\u00edan el mismo tratamiento anal\u00edtico<b style=\"mso-bidi-font-weight: normal;\">.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 11.0pt;\">La situaci\u00f3n final a la que hemos<br \/>\nllegado en el ejemplo planteado seria que con un coste de urbanizaci\u00f3n que el<br \/>\npromotor debe ejecutar a su cargo por importe de 13.252.148 euros, tendr\u00eda<br \/>\nderecho al siguiente aprovechamiento urban\u00edstico<\/span><\/b><span style=\"font-size: 11.0pt;\">:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div realizar dos observaciones<br \/>\nimportantes<\/span><\/b><span style=\"font-size: 11.0pt;\"> que dejan inconcluso el<br \/>\ntrabajo del promotor:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">En<br \/>\nprimer lugar hay que se\u00f1alar que <b style=\"mso-bidi-font-weight: normal;\">al<br \/>\nrebasar el presupuesto de obras de urbanizaci\u00f3n la cifra m\u00ednima legal<br \/>\ncontemplada en la LUV, la contrataci\u00f3n de la urbanizaci\u00f3n saldr\u00eda a concurso<br \/>\np\u00fablico <\/b>y, es muy probable que,<span style=\"mso-spacerun: yes;\">&nbsp;<br \/>\n<\/span>dadas las condiciones actuales del mercado se pudiera adjudicar con una<br \/>\nbaja considerable.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\"><span style=\"mso-spacerun: yes;\">&nbsp;<\/span>En segundo lugar, <b style=\"mso-bidi-font-weight: normal;\">el promotor debe realizar un estudio econ\u00f3mico financiero para<br \/>\ncomprobar que las promociones inmobiliarias que le ser\u00e1n adjudicadas son<br \/>\nviables<\/b>.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">Para<br \/>\nrealizar este estudio aconsejamos acudir al programa GESTINMO y, como tiene dos<br \/>\ntipolog\u00edas distintas de viviendas (148 de VPP \u2013 RG y 160 libres) deber\u00e1<br \/>\nrepartir el coste total presupuestado en concepto de urbanizaci\u00f3n entre ambas<br \/>\ntipolog\u00edas, aunque es evidente que podr\u00e1 imputar libremente el referido coste.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">Dado<br \/>\nque la urbanizaci\u00f3n se ejecutar\u00eda primero, el PROMOTOR puede analizar la<br \/>\nsituaci\u00f3n que mas le convenga: realizar primero o de forma simult\u00e1nea la VPP, o<br \/>\nbien la VL, o tambi\u00e9n cabe la posibilidad de analizar la alternativa de<br \/>\nacometer las dos promociones juntas de forma simult\u00e1nea a la urbanizaci\u00f3n o<br \/>\ntambi\u00e9n desfasadas en el tiempo<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">Para<br \/>\neste an\u00e1lisis, una vez ajustada la operaci\u00f3n con el programa GESTINMO, en<br \/>\ncuanto a la viabilidad econ\u00f3mica de ambas promociones, para estudiar el<br \/>\nan\u00e1lisis financiero recomendamos el uso de INMOFASE que permite elaborar todas<br \/>\nlas alternativas de desfase en el tiempo que se elijan<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 11.0pt;\">Pudiera suceder que<\/span><\/b><span style=\"font-size: 11.0pt;\">, con la imputaci\u00f3n del coste de urbanizaci\u00f3n que se<br \/>\nelija, <b style=\"mso-bidi-font-weight: normal;\">las VPP no presentaran resultados<br \/>\npositivos, con lo que el PROMOTOR deber\u00e1 efectuar un desvio de costes hacia la<br \/>\nVL y<\/b> subirlas de precio de venta, si el mercado as\u00ed lo permitiera, una vez<br \/>\ndesfasada convenientemente en el tiempo su ejecuci\u00f3n.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 11.0pt;\">ACLARACION.-<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">El ejemplo num\u00e9rico que hemos analizado<br \/>\ny sus alternativas de soluciones urban\u00edsticas planteadas, aunque parezcan<br \/>\ndisparatadas, se corresponden, con ligeros cambios y matices a un caso real<\/b>,<br \/>\npor lo que <b style=\"mso-bidi-font-weight: normal;\">la nueva estrategia propuesta<br \/>\nno es ning\u00fan disparate <\/b>y presenta como novedad estrat\u00e9gica la de<br \/>\ncolaboraci\u00f3n con los pol\u00edticos del Ayuntamiento, para que comprendan la<br \/>\nsituaci\u00f3n y junto a los t\u00e9cnicos municipales <b style=\"mso-bidi-font-weight: normal;\">se elaboren alternativas t\u00e9cnicas de soluci\u00f3n acordes con los tiempos<br \/>\nque vive actualmente el urbanismo si queremos mantener su nivel de calidad lo<br \/>\nmenos afectado posible,<\/b> ya que es el propio ayuntamiento el que, a veces,<br \/>\nse ve afectado directamente por cesiones de suelo, por ejemplo, que su nivel<br \/>\npresupuestario le impiden mantener adecuadamente. <\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 11.0pt;\">NOTA.- <\/span><\/b><span style=\"font-size: 11.0pt;\">Estos
