href=\"https:\/\/www.boe.es\/boe\/dias\/2013\/06\/27\/pdfs\/BOE-A-2013-6938.pdf\">Rehabilitaci\u00f3n,<br \/>\nRegeneraci\u00f3n y Renovaci\u00f3n Urbanas <\/a><\/b><span style=\"mso-spacerun: yes;\">&nbsp;<\/span>y tambi\u00e9n recientemente el <b>Plan de Vivienda<br \/>\ny Rehabilitaci\u00f3n 2013 \u2013 2016.<\/b><\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">Pensamos que <b>el momento oportuno para comentar<br \/>\nambas disposiciones seria cuando las CCAA las incorporaran a su legislaci\u00f3n<\/b><br \/>\nen materia de edificaci\u00f3n, ya que su aplicaci\u00f3n es de la sola competencia<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>de \u00e9stas y. adem\u00e1s falta un requisito<br \/>\nesencial como la de que el Estado acuerde con ellas la financiaci\u00f3n<br \/>\ncorrespondiente.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Pero<br \/>\nal repasar el texto recientemente<\/span><\/b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\"> ( y pedimos disculpas a los<br \/>\nlectores de nuestro BLOG por ello)<b>, nos encontramos con que, en las<br \/>\ndisposiciones transitorias y finales de dicha ley se modifica la ley del suelo<br \/>\nestata<\/b>l, que tambi\u00e9n queda para su aplicaci\u00f3n real que las CCAA tomen las<br \/>\ndecisiones oportunas al respecto.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<br \/>\n<!--more--><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Es<br \/>\nuna t\u00e9cnica jur\u00eddica que, no acabamos de comprender<\/span><\/b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">, <b>que<br \/>\nla modificaci\u00f3n de la ley del suelo<\/b> (como otras tambi\u00e9n muy importantes y<br \/>\nque, a diferencia de la anterior, nada tienen que ver con el sector), <b>se<br \/>\nincluyan en esta ley cuyo enunciado es claramente distinto<\/b>, pero, en fin,<br \/>\nque le vamos a hacer.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">A veces nos preguntamos si los legisladores quieren<br \/>\ncambiar las reglas de juego, para mejor,<span style=\"mso-spacerun: yes;\">&nbsp;<br \/>\n<\/span>o \u201cpillarnos en un renuncio\u201d a los, en este caso, s\u00fabditos.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">As\u00ed pues, una vez pedido los perdones convenientes,<br \/>\nnos dedicaremos a realizar los comentarios a la <b>modificaci\u00f3n de la ley<br \/>\nestatal del suelo<\/b>, cuyo texto refundido se aprueba por <b>Real Decreto<br \/>\nLegislativo 2\/2008 de 20 de junio<\/b>.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">En<br \/>\nprimer lugar y, para que los que les ha pasado lo mismo que a nosotros, el<br \/>\ncontenido de la modificaci\u00f3n afecta a los <b style=\"mso-bidi-font-weight: normal;\">art\u00edculos<br \/>\n2, 5, 6, 8 a<br \/>\n10, 12, 14 a<br \/>\n17, 20, 36, 37, 39, 51 y 53, la disposici\u00f3n adicional tercera y la disposici\u00f3n<br \/>\nfinal primera del texto refundido de la<br \/>\n Ley de Suelo, aprobado por el Real Decreto Legislativo<br \/>\n2\/2008, de 20 de junio, <\/b><\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">Adem\u00e1s existe una Disposici\u00f3n transitoria que<br \/>\npermite a las CCAA dejar en suspenso la obligaci\u00f3n de reservar suelo para<br \/>\nconstruir Viviendas de Protecci\u00f3n Publica, por el plazo de cuatro a\u00f1os, si se<br \/>\ncumplen determinadas condiciones.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; LA<br \/>\n   MODIFICACION:<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">No<br \/>\n  se trata de una nueva ley del suelo con un cambio de modelo sobre el actual<br \/>\n  que se acomode a la situaci\u00f3n real de la economia del pais y del sector<br \/>\n  inmobiliario en particular. Se trata pues, de una modificaci\u00f3n del texto<br \/>\n  aprobado en 2008 que presenta matices pero no modifica la esencia. En nuestra<br \/>\n  opini\u00f3n ser\u00e1 dif\u00edcil que la iniciativa privada se acomode a transformar<br \/>\n  suelo.<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b><span style=\"color: black; mso-bidi-font-size: 11.0pt;\">LA<br \/>\nHORQUILLA DE CESION DE APROVECHAMIENTO SE MANTIENE<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b><span style=\"color: black; mso-bidi-font-size: 11.0pt;\">En<br \/>\nefecto en la Disposici\u00f3n Final Decima de la Ley 8(2013 de 26 de junio se se\u00f1ala el nuevo<br \/>\ntexto legal para el Art\u00edculo 16.1 apartados a) y b) de la Ley del Suelo que es el<br \/>\nsiguiente:<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Art\u00edculo 16.1<\/span><\/b><span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">:<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Deberes<br \/>\nvinculados a la promoci\u00f3n de las actuaciones de transformaci\u00f3n urban\u00edstica y a<br \/>\nlas actuaciones edificatorias.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">1.<br \/>\nLas actuaciones de <u>urbanizaci\u00f3n a que se refiere el art\u00edculo 14.1 a)<\/u> comportan los<br \/>\nsiguientes deberes legales:<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">a) <b style=\"mso-bidi-font-weight: normal;\">Entregar a la Administraci\u00f3n<br \/>\ncompetente el suelo reservado para viales espacios libres, zonas verdes y<br \/>\nrestantes dotacione<\/b>s p\u00fablicas incluidas en la propia actuaci\u00f3n o adscritas<br \/>\na ella para su obtenci\u00f3n.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #c00000; mso-bidi-font-size: 14.0pt;\">NUEVA REDACCION<\/span><\/i><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"color: #c00000; mso-bidi-font-size: 14.0pt;\">En estos suelos se incluir\u00e1,<br \/>\ncuando deban formar parte de actuaciones de urbanizaci\u00f3n cuyo uso predominante<br \/>\nsea el residencial, los que el instrumento de ordenaci\u00f3n adscriba a la dotaci\u00f3n<br \/>\np\u00fablica de viviendas sometidas a alg\u00fan r\u00e9gimen de protecci\u00f3n, con destino<br \/>\nexclusivo al alquiler, tanto en los supuestos en que as\u00ed se determine por la<br \/>\nlegislaci\u00f3n aplicable, como cuando de la memoria del correspondiente instrumento<br \/>\nse derive la necesidad de contar con este tipo de viviendas de naturaleza<br \/>\nrotatoria, y cuya finalidad sea atender necesidades temporales de colectivos<br \/>\ncon especiales dificultades de acceso a la vivienda.<\/span><\/i><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">b) <b style=\"mso-bidi-font-weight: normal;\">Entregar a la Administraci\u00f3n<br \/>\ncompetente, y con destino a patrimonio p\u00fablico de suelo<\/b>, el suelo libre de<br \/>\ncargas de urbanizaci\u00f3n correspondiente <b style=\"mso-bidi-font-weight: normal;\">al<br \/>\nporcentaje de la edificabilidad media ponderada de la actuaci\u00f3n<\/b>, o del<br \/>\n\u00e1mbito superior de referencia en que \u00e9sta se incluya, que fije la legislaci\u00f3n<br \/>\nreguladora de la ordenaci\u00f3n territorial y urban\u00edstica.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Con<br \/>\ncar\u00e1cter general, el porcentaje a que se refiere el p\u00e1rrafo anterior <b style=\"mso-bidi-font-weight: normal;\">no podr\u00e1 ser inferior al 5 por ciento ni<br \/>\nsuperior al 15 por ciento.<\/b><\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">La<br \/>\nlegislaci\u00f3n sobre ordenaci\u00f3n territorial y urban\u00edstica podr\u00e1 permitir<br \/>\nexcepcionalmente reducir o incrementar este porcentaje de forma proporcionada y<br \/>\nmotivada, hasta alcanzar un m\u00e1ximo del 20 por ciento en el caso de su<br \/>\nincremento, para las actuaciones o los \u00e1mbitos en los que el valor de las<br \/>\nparcelas resultantes sea sensiblemente inferior o superior, respectivamente, al<br \/>\nmedio en los restantes de su misma categor\u00eda de suelo. <\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">La<br \/>\nlegislaci\u00f3n sobre ordenaci\u00f3n territorial y urban\u00edstica podr\u00e1 determinar los<br \/>\ncasos y condiciones en que quepa sustituir la entrega del suelo por otras<br \/>\nformas de cumplimiento del deber, excepto cuando pueda cumplirse con suelo<br \/>\ndestinado a vivienda sometida a alg\u00fan r\u00e9gimen de protecci\u00f3n p\u00fablica en virtud<br \/>\nde la reserva a que se refiere la letra b) del apartado 1 del <u>art\u00edculo 10.c)<\/u><br \/>\n<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<table border=\"1\" cellpadding=\"0\" cellspacing=\"0\" class=\"MsoNormalTable\" style=\"border-collapse: collapse; border: none; mso-border-alt: solid windowtext .5pt; mso-bidi-font-size: 14.0pt;\">Como sabemos la mayor\u00eda de<br \/>\n  las CCAA adoptan un porcentaje de cesi\u00f3n del 10 %.
