mso-bidi-font-weight: bold;\">b) Destinar suelo adecuado y suficiente para usos<br \/>\nproductivos y para uso residencial, con <b>reserva en todo caso de una parte<br \/>\nproporcionada a vivienda sujeta a un r\u00e9gimen de protecci\u00f3n p\u00fablica <\/b>que, al<br \/>\nmenos, permita establecer su precio m\u00e1ximo en venta, alquiler u otras formas de<br \/>\nacceso a la vivienda, como el derecho de superficie o la concesi\u00f3n<br \/>\nadministrativa.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<br bold;\">Esta reserva ser\u00e1 determinada por la legislaci\u00f3n<br \/>\nsobre ordenaci\u00f3n territorial y urban\u00edstica o, de conformidad con ella, por los<br \/>\ninstrumentos de ordenaci\u00f3n, garantizar\u00e1 una distribuci\u00f3n de su localizaci\u00f3n<br \/>\nrespetuosa con el principio de cohesi\u00f3n social y comprender\u00e1, <b>como m\u00ednimo,<br \/>\nlos terrenos necesarios para realizar el 30 por ciento de la edificabilidad<br \/>\nresidencial <\/b>prevista por la ordenaci\u00f3n urban\u00edstica en el suelo rural que<br \/>\nvaya a ser incluido en actuaciones de nueva urbanizaci\u00f3n y el 10 por ciento en<br \/>\nel suelo urbanizado que deba someterse a actuaciones de reforma o renovaci\u00f3n de<br \/>\nla mismo<br \/>\n  esfuerzo financiero realizar una promoci\u00f3n de VPP en venta que en alquiler.<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: style=\"mso-spacerun: yes;\">&nbsp; <\/span>DE RESERVA<br \/>\nDE SUELO PARA LA<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>CONSTRUCCION DE<br \/>\nVIVIENDAS DE PROTECCION PUBLICA<\/span><\/b><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt; mso-bidi-font-weight: bold;\">En la <b>Disposici\u00f3n transitoria Tercera <\/b>de la <b>Ley<\/b><b> 8\/2013 de<br \/>\nRehabilitaci\u00f3n, Renovaci\u00f3n y Regeneraci\u00f3n Urbanas<\/b> se dispone lo siguiente<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">Durante<br \/>\nun plazo m\u00e1ximo de <b style=\"mso-bidi-font-weight: normal;\">cuatro a\u00f1os a contar<br \/>\ndesde la entrada en vigor de esta Ley (es decir hasta el 30 de junio de 2017)<\/b><br \/>\nlas Comunidades Aut\u00f3nomas podr\u00e1n <b style=\"mso-bidi-font-weight: normal;\">dejar<br \/>\nen suspenso<\/b> <b style=\"mso-bidi-font-weight: normal;\">la aplicaci\u00f3n de lo<br \/>\ndispuesto en el art\u00edculo 10.1 b)<\/b> del texto refundido de la Ley de Suelo, aprobado por el<br \/>\nReal Decreto Legislativo 2\/2008, de 20 de junio, determinando el per\u00edodo de<br \/>\nsuspensi\u00f3n y los instrumentos de ordenaci\u00f3n a que afecte, <b style=\"mso-bidi-font-weight: normal;\">siempre que se cumplan, como m\u00ednimo, los siguientes requisitos:<\/b><\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">a)<br \/>\nQue los citados instrumentos justifiquen la existencia de un porcentaje de<br \/>\nvivienda protegida ya construida y sin vender en el Municipio, superior al 15<br \/>\npor ciento de las viviendas protegidas previstas o resultantes del planeamiento<br \/>\nvigente y una evidente desproporci\u00f3n entre la reserva legalmente exigible y la<br \/>\ndemanda real con posibilidad de acceder a dichas viviendas.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<span style=\"color: #333333; mso-bidi-font-size: 14.0pt;\">b)<br \/>\nQue dichos instrumentos de ordenaci\u00f3n no hayan sido aprobados definitivamente<br \/>\nantes de la entrada en vigor de esta Ley o que, en el caso de haber sido<br \/>\naprobados, no cuenten a\u00fan con la aprobaci\u00f3n definitiva del proyecto o proyectos<br \/>\nde equidistribuci\u00f3n necesarios.<\/span><\/div>\n<div style=\"mso-layout-grid-align: none; text-align: justify; text-autospace: none;\">\n<\/div>\n<table border=\"1\" con la<br \/>\n  discusi\u00f3n que se esta produciendo sobre la oportunidad o no de seguir con el<br \/>\n  modelo de VPP,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>y establecer sin<br \/>\n  ninguna otra condici\u00f3n, la suspensi\u00f3n de la obligaci\u00f3n en el plazo de 54 a\u00f1os<br \/>\n  en correspondencia con el nuevo Plan de Vivienda 2013 \u2013 2016 que por, ahora,<br \/>\n
