\njunio , de Rehabilitaci\u00f3n,
\nRegeneraci\u00f3n y Renovaci\u00f3n Urbanas <\/a><\/b> <\/span>y tambi\u00e9n recientemente el Plan de Vivienda
\ny Rehabilitaci\u00f3n 2013 \u2013 2016.<\/b><\/span><\/div>\n
\n<\/div>\n
\nPero
\nal repasar el texto ULTIMAMENTE<\/span><\/b> (y pedimos disculpas a los lectores
\nde nuestro BLOG por ello), nos encontramos con que, en las disposiciones
\ntransitorias y finales de dicha ley se modifica diversas leyes de importancia
\npara el sector, que relacionamos<\/b><\/span>

\nA)-
\nMODIFICACI\u00d3N DE LA LEY DE PROPIEDAD
\nHORIZONTAL <\/span><\/u><\/b><\/div>\n
\nEn la
\n Disposici\u00f3n final primera de la Ley 8(2013), se dispone la Modificaci\u00f3n de la Ley 49\/1960, de 21 de julio,
\nsobre Propiedad Horizontal.<\/span><\/div>\n
\nSe modifican los art\u00edculos 2, 3, 9, 10 y 17 y la
\ndisposici\u00f3n adicional   <\/span>y QUEDAN
\nDEROGADOS  <\/span>Los art\u00edculos 8, 11 y 12 de la
\ncitada  <\/span>ley<\/span><\/div>\n

\nCOMENTARIO <\/span><\/u><\/div>\n
\nModificaci\u00f3n
\nmuy l\u00f3gica ya que tiene el objetivo de simplificar los tr\u00e1mites y votaciones y
\nqu\u00f3rum necesarios para que las Comunidades de Propietarios puedan aprobar con
\nla menor dilaci\u00f3n posible las actuaciones de rehabilitaci\u00f3n de los edificios.<\/span><\/b><\/div>\n

\nMODIFICACI\u00d3N DE LA LEY DE ORDENACI\u00d3N
\nDE LA EDIFICACI\u00d3N<\/span><\/u><\/b><\/div>\n
\nEn la
\n Disposici\u00f3n final tercera de la Ley 8\/2013, se dispone la
\nModificaci\u00f3n de la Ley
\n38\/1999, de 5 de noviembre, de Ordenaci\u00f3n de la Edificaci\u00f3n.<\/span><\/div>\n
\nSe modifican los siguientes art\u00edculos de la  <\/span>Ley de Ordenaci\u00f3n de la Edificaci\u00f3n: Art\u00edculo
\n2.2, Art\u00edculo 3.1 (p\u00e1rrafo primero) Requisitos b\u00e1sicos de la edificaci\u00f3n,
\nArt\u00edculo 3.2 (p\u00e1rrafo primero)y QUEDA DEROGADO El apartado 5 del art\u00edculo 2 del
\nReal Decreto 314\/2006, de 17 de marzo, por el que se aprueba el C\u00f3digo T\u00e9cnico
\nde la  <\/span>Edificaci\u00f3n<\/span><\/div>\n

\nCOMENTARIO <\/span><\/u><\/div>\n
\nLa
\nmodificaci\u00f3n tambi\u00e9n est\u00e1 llena de l\u00f3gica, al tratar de incardinar en la Ley de Ordenaci\u00f3n de la Edificaci\u00f3n la
\nactividad de rehabilitaci\u00f3n de edificios<\/span><\/b><\/div>\n
\n<\/div>\n
\n<\/div>\n
\n<\/div>\n
\nC) MODIFICACI\u00d3N
\nDEl C\u00d3DIGO T\u00c9CNICO DE LA EDIFICACI\u00d3N, Real Decreto 314\/2006, de 17 de marzo <\/span><\/u><\/b><\/div>\n
\ncon el objeto de resolver los problemas que plantea
\nen relaci\u00f3n con la rehabilitaci\u00f3n, y que vienen siendo reclamados por los
\nprincipales agentes del sector. <\/span><\/div>\n
\n<\/div>\n
\nCOMENTARIO <\/span><\/u><\/div>\n
\nEntre
\ndichas modificaciones, destacan las que tratan de eliminar las definiciones
\nrelacionadas con obras de rehabilitaci\u00f3n que actualmente inducen a error, la
\ninclusi\u00f3n de los criterios de flexibilidad y no empeoramiento en la aplicaci\u00f3n
\ndel C\u00f3digo T\u00e9cnico a las intervenciones en edificios existentes y, por \u00faltimo,
\nla obligaci\u00f3n de declarar el nivel de prestaciones alcanzado y las condiciones
\nde uso y mantenimiento derivadas de la intervenci\u00f3n. <\/span><\/b><\/div>\n
\n<\/div>\n
\nEn
\nlos dos \u00faltimos casos, se trata de aportar un elemento de transparencia en el
\nmercado y de puesta en valor de la rehabilitaci\u00f3n. Todo
\nello con independencia de que se vayan realizando posteriores modificaciones de
\neste C\u00f3digo, con car\u00e1cter eminentemente t\u00e9cnico, con la finalidad de ir
\nadapt\u00e1ndolo a la intervenci\u00f3n sobre edificios existentes, que revestir\u00edan ya la
