EDIFICIO<\/span><\/h2>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\">La constituci\u00f3n del <b style=\"mso-bidi-font-weight: normal;\">R\u00e9gimen de<br \/>\nPropiedad Horizontal en un Edificio<\/b> consiste en <b style=\"mso-bidi-font-weight: normal;\">identificar las fincas privativas<\/b> que lo constituyen:<b style=\"mso-bidi-font-weight: normal;\"> Viviendas, Locales Comerciales, Garaje y<br \/>\nTrasteros<\/b>, identificar <b style=\"mso-bidi-font-weight: normal;\">asimismo los<br \/>\nelementos comunes<\/b> del mismo <b style=\"mso-bidi-font-weight: normal;\">y<br \/>\nrepartirlos<\/b> entre los elementos privativos <b style=\"mso-bidi-font-weight: normal;\">por medio de un coeficiente de propiedad<\/b> que se identificara con<br \/>\ncada inmueble privativo del edificio de forma que la propiedad sea el 100% entre<br \/>\ntodos ellos<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\">&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\"><\/p>\n<div class=\"separator\" style=\"clear: both; style=\"mso-bidi-font-size: 20.0pt;\">De forma que el propietario del piso 3 izquierda, por ejemplo,<br \/>\nadem\u00e1s de ser propietario de ella tiene la propiedad que jur\u00eddicamente es<br \/>\nespecial ya que se trata<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>una propiedad <b style=\"mso-bidi-font-weight: normal;\">en proindiviso e indivisible<\/b> (lo que no<br \/>\nsucede en otros proindivisos) de un 0,09 coeficiente de propiedad, de los<br \/>\nelementos comunes del edificio y, en funci\u00f3n precisamente de este coeficiente<br \/>\ndebe asumir su mantenimiento e incluso su reconstrucci\u00f3n en casi de ruina del<br \/>\nedificio.<\/span><\/div>\n<\/p>\n<p><\/p>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">El referido r\u00e9gimen de divisi\u00f3n<br \/>\nhorizontal se formaliza en escritura p\u00fablica<\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\"> sujeta al impuesto de AJD (Actos Jur\u00eddicos Documentados) cuya <b style=\"mso-bidi-font-weight: normal;\">base imponible es la suma del valor del<br \/>\nsuelo m\u00e1s el de la construcci\u00f3n.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Sobre el <b style=\"mso-bidi-font-weight: normal;\">valor del suelo<\/b> ya<br \/>\nhemos hecho los considerandos en una publicaci\u00f3n anterior cuando se hablaba de<br \/>\nla <b style=\"mso-bidi-font-weight: normal;\">declaraci\u00f3n de obra nueva<\/b>, ya que<br \/>\nes obvio que el valor en ambas escrituras <b style=\"mso-bidi-font-weight: normal;\">ha<br \/>\nde ser coincidente<\/b>.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Sobre el valor del suelo podemos <b style=\"mso-bidi-font-weight: normal;\">consignar<br \/>\nel precio de adquisici\u00f3n<\/b> o, si es menor, la <b style=\"mso-bidi-font-weight: normal;\">tasaci\u00f3n<\/b> que seguramente se habr\u00e1 realizado si este fue adquirido<br \/>\ncon hipoteca. En ambos casos tenemos una justificaci\u00f3n para el caso de que la Administraci\u00f3n<br \/>\nproceda a efectuar una correcci\u00f3n en su valoraci\u00f3n.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">Es frecuente que las escrituras<br \/>\nde obra nueva y divisi\u00f3n horizontal se fundan en una sola, pero esto no quiere<br \/>\ndecir que se ahorren impuestos<\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\">,<br \/>\nya que la operaci\u00f3n se gravara con el valor del solar mas dos veces el valor de<br \/>\nla construcci\u00f3n, el \u00fanico ahorro ser\u00e1n el de la utilizaci\u00f3n de menos folios<br \/>\nnotariales.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Tambi\u00e9n <b style=\"mso-bidi-font-weight: normal;\">es muy conveniente<br \/>\nincluir<\/b> en la escritura de divisi\u00f3n horizontal los E<b style=\"mso-bidi-font-weight: normal;\">statutos de la comunidad <\/b>ya que, en este caso, estar\u00e1n exentos de<br \/>\npagar impuestos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Ahora bien, <b style=\"mso-bidi-font-weight: normal;\">estos estatutos<br \/>\ndeben contener exclusivamente las clausulas que faciliten el funcionamiento de<br \/>\nla comunidad de propietarios desde el punto de vista del promotor y la<br \/>\ncomercializaci\u00f3n<\/b> de sus productos y dejar que el resto de asuntos de la<br \/>\nvida cotidiana de la comunidad de propietarios la establezcan ellos mismos de<br \/>\nforma privada. Dichos clausulas pueden ser las siguientes, entre otras:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 39.75pt; mso-list: l0 level1 lfo1; tab-stops: list 39.75pt; text-align: justify; text-indent: -21.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">La<br \/>\naceptaci\u00f3n por parte de los futuros comuneros de <b style=\"mso-bidi-font-weight: normal;\">que el promotor puede efectuar divisiones o agrupaciones internas de<br \/>\nlos locales comercial<\/b>es sin variar el coeficiente global que les<br \/>\ncorresponda en la divisi\u00f3n horizontal.<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 39.75pt; mso-list: l0 level1 lfo1; tab-stops: list 39.75pt; text-align: justify; text-indent: -21.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">Que los <b style=\"mso-bidi-font-weight: normal;\">propietarios de los locales comerciales<br \/>\ntienen derecho<\/b> por el coeficiente que les corresponde <b style=\"mso-bidi-font-weight: normal;\">a entrar por el portal y subir por el montacargas<\/b> los materiales<br \/>\nnecesarios para colocar en la cubierta del edificio las instalaciones de aire<br \/>\nacondicionado que necesiten, para lo cual podr\u00e1n<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>igualmente acceder a la cubierta del<br \/>\nedificio.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 39.75pt; mso-list: l0 level1 lfo1; tab-stops: list 39.75pt; text-align: justify; text-indent: -21.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">c)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">Que <b style=\"mso-bidi-font-weight: normal;\">el promotor tiene derecho<\/b> sin que<br \/>\npuedan oponerse los comuneros a negociar con las empresas que correspondan <b style=\"mso-bidi-font-weight: normal;\">la instalaci\u00f3n en la cubierta del edificio,<br \/>\nen su caso, de r\u00f3tulos publicitarios o de antenas de telefon\u00eda y tv,<\/b><br \/>\ndebiendo repartir los posibles beneficios que reporten las mismas en partes<br \/>\niguales entre comunidad de propietarios y promotor.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 39.75pt; mso-list: l0 level1 lfo1; tab-stops: list 39.75pt; text-align: justify; text-indent: -21.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">d)<span style=\"font: 7pt &quot;Times New los locales comerciales<br \/>\nno tiene derecho al uso y disfrute de los elementos comunes del tipo piscina,<br \/>\np\u00e1del, tenis<\/b>, etc.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 39.75pt; mso-list: l0 level1 lfo1; tab-stops: list 39.75pt; text-align: justify; text-indent: -21.75pt;\">\n<span style=\"mso-bidi-font-size: style=\"mso-bidi-font-size: 20.0pt;\">Que los<br \/>\npropietarios de las plazas de garaje, en su caso, que no sean propietarios de<br \/>\npisos tienen derecho al acceso por el garaje a trav\u00e9s del portal y su<br \/>\ncomunicaci\u00f3n con aquel,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>y, en<br \/>\nconsecuencia, a recibir de la comunidad de propietarios una llave para acceso<br
