style=\"mso-bidi-font-size: 20.0pt;\">En general las Ordenanza Municipales de construcci\u00f3n <b style=\"mso-bidi-font-weight: normal;\">cuando en un edificio permiten la<br \/>\nconstrucci\u00f3n de plantas \u00e1tico ordenan retranquear su fachada<\/b> respecto a la<br \/>\nfachada del edificio (y esto puede suceder en la fachada principal y la trasera<br \/>\ncuando da a calle publica y tambi\u00e9n cuando la fachada trasera del edificio da a<br \/>\npatio mancomunado aunque a veces esto no sucede).<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\">&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\"><\/p>\n<div class=\"separator\" style=\"clear: both; text-align: center;\"><a style=\"mso-bidi-font-size: 20.0pt;\">Este retranqueo obligatorio supone<br \/>\nque los pisos \u00e1tico tengan menor superficie cubierta que los de la planta<br \/>\ninferior<\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\"> o de pisos. En<br \/>\nconsecuencia, entre la l\u00ednea vertical de las dos fachadas <b style=\"mso-bidi-font-weight: normal;\">aparece una terraza<\/b>, situada sobre la cubierta del piso inferior,<br \/>\ny, por tanto, zona com\u00fan del edificio.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">L\u00f3gicamente esta terraza (en general muy amplia) no se puede vender<br \/>\nincorpor\u00e1ndola al piso o pisos en \u00e1tico de esa planta, <b style=\"mso-bidi-font-weight: normal;\">pero lo que si se puede hacer es cederlas en uso privativo de esos<br \/>\n\u00e1ticos<\/b>. Y este uso cedido <b style=\"mso-bidi-font-weight: normal;\">se hace<br \/>\nconstar en la escritura de divisi\u00f3n horizontal<\/b> atribuyendo su uso privativo<br \/>\na un determinado piso en \u00e1tico.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Esta circunstancia hace que dicho piso se incremente de valor y, en la<br \/>\nconstituci\u00f3n del r\u00e9gimen de propiedad horizontal puede actuarse de dos maneras:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 57pt; mso-list: l0 level1 lfo1; tab-stops: list 57.0pt; text-align: justify; text-indent: -39pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">No tener<br \/>\nen cuenta esta circunstancia considerando a efectos de reparto la superficie<br \/>\ninterior del \u00e1tico.<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 57pt; mso-list: l0 level1 lfo1; tab-stops: list 57.0pt; text-align: justify; text-indent: -39pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\">Introducir,<br \/>\nen los pisos \u00e1tico, un <b style=\"mso-bidi-font-weight: normal;\">coeficiente de<br \/>\nponderaci\u00f3n que valore esta circunstancia.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Cualquiera de estas variantes es valida<br \/>\nexcepto, como ya hemos indicado la atribuci\u00f3n de la propiedad de la terraza que<br \/>\naparece en la cubierta del edificio y como tal es zona com\u00fan.<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">En los casos de atribuci\u00f3n del uso ser\u00e1<br \/>\nnecesario introducir en los estatutos el r\u00e9gimen de conservaci\u00f3n y<br \/>\nmantenimiento de dicho espacio, que ser\u00e1 a cargo del piso \u00e1tico que lo utiliza<br \/>\nprivativamente, teniendo como servidumbre el paso de personal t\u00e9cnico enviado<br \/>\npor la comunidad para verificar su estado en todo momento ya que, si existen<br \/>\nproblemas derivados del dise\u00f1o del edificio dichas reparaciones ser\u00e1n a cargo<br \/>\nde la comunidad de propietarios.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<h3>\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">TRATAMIENTO DE LOS ESPACIOS<br \/>\nABUHARDILLADOS<\/span><\/b><\/h3>\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">En general en el tratamiento de estos espacios pueden darse las<br \/>\nsiguientes situaciones:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 40.5pt; mso-list: l1 level1 lfo2; tab-stops: list 40.5pt; text-align: justify; text-indent: -22.5pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt &quot;Times New de trastero autorizado en<br \/>\nlicencia y como tal forma una unidad registral independiente o un proindiviso<br \/>\ncon toda la planta dedicada a cubierta a este uso.<\/span><\/b><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 40.5pt; mso-list: l1 level1 lfo2; tab-stops: list 40.5pt; text-align: justify; text-indent: -22.5pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">Tiene un uso de vivienda, permiti\u00e9ndose en<br \/>\nlicencia la comunicaci\u00f3n con la vivienda situada en el piso inferior, formando<br \/>\nuna unidad registral \u00fanica en forma de piso d\u00faplex.<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">En otros casos de utilizaci\u00f3n unidos o no a la vivienda del piso<br \/>\ninferior que no est\u00e9 autorizado no tiene vida registral como
