O PATIO en Edificios<\/span><\/h2>\n<\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\">&nbsp;<br \/><\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"mso-bidi-font-size: 20.0pt;\">En general <b style=\"mso-bidi-font-weight: normal;\">las viviendas<br \/>\nsituadas en planta baja<\/b>, <b style=\"mso-bidi-font-weight: normal;\">adem\u00e1s de<br \/>\ntener una superficie inferior a las de plantas de pisos<\/b> dado que en dicha planta<br \/>\nbaja coexiste el portal del edificio y pueden existir tambi\u00e9n locales<br \/>\ncomerciales, tienen una <b style=\"mso-bidi-font-weight: normal;\">ubicaci\u00f3n habitualmente<br \/>\npoco interesante<\/b> para los posibles compradores.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Estas dos circunstancias mencionadas, situaci\u00f3n (vistas propias como de<br \/>\nlos viandantes, seguridad, etc.) y menor superficie hacen que la<br \/>\ncomercializaci\u00f3n y, en consecuencia <b style=\"mso-bidi-font-weight: normal;\">esa<br \/>\ntipologia tenga un valor menor en el mercado.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div class=\"separator\" style=\"clear: both; text-align: center;\"><a href=\"https:\/\/1.bp.blogspot.com\/-aVZYh-ZFqs4\/X_RVcJm0QWI\/AAAAAAAAAuc\/lQ-moCVGBBE8m74hbnKoYPoJpcQ2irJyQCLcBGAsYHQ\/s150\/manpl1.jpg\" imageanchor=\"1\" style=\"margin-left: 1em; margin-right: 1em;\"><img decoding=\"async\" border=\"0\" data-original-height=\"99\" data-original-width=\"150\" justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">Para obviar este problema<\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\"> y tratar de aumentar el precio y las<br \/>\nfacilidades de venta de estos pisos en planta baja, los promotores<span style=\"mso-spacerun: yes;\">&nbsp; <\/span><b style=\"mso-bidi-font-weight: normal;\">cuando<br \/>\nlo permite el dise\u00f1o<\/b> piden a sus arquitectos que les <b style=\"mso-bidi-font-weight: normal;\">vinculen unos espacios exteriores que puedan usar como jardines o<br \/>\nterrazas privativas<\/b>.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">El problema de esta vinculaci\u00f3n<br \/>\nes id\u00e9ntico al de las terrazas de los pisos \u00e1tico<\/span><\/b><span style=\"mso-bidi-font-size: 20.0pt;\">, ya tratado en anteriores publicaciones, que<br \/>\nsuelen ser espacios comunes y por tanto no se les puede asignar la propiedad<br \/>\nsino el uso. Esto sucede en los dos casos siguientes:<\/span><br \/>\n<span style=\"mso-bidi-font-size: 20.0pt;\"><\/span><br \/>\n<!--more--><span style=\"mso-bidi-font-size: 20.0pt;\">&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 42.75pt; mso-list: l0 level1 lfo1; tab-stops: list 42.75pt; text-align: justify; text-indent: -24.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">Cuando<br \/>\nel espacio esta sobre la cubierta de un garaje subterr\u00e1neo,<\/span><\/div>\n<div style=\"margin-left: 18pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 42.75pt; mso-list: l0 level1 lfo1; tab-stops: list 42.75pt; text-align: justify; text-indent: -24.75pt;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\"><span style=\"mso-list: Ignore;\">b)<span style=\"font: 7pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"mso-bidi-font-size: 20.0pt;\">Cuando<br \/>\nla ocupaci\u00f3n m\u00e1xima permitida por ordenanzas urban\u00edsticas en planta baja esta<br \/>\nagotada. En cuyo caso el espacio exterior al ocupado por el bloque de<br \/>\nedificaci\u00f3n en planta baja es zona com\u00fan y por tanto el espacio privativo se<br \/>\nextrae precisamente de este \u00faltimo.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Pero a diferencia de lo que sucede con las terrazas de los pisos \u00e1tico,<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">existe un caso en el que si podemos<br \/>\natribuir la propiedad del espacio exterior al piso o pisos bajos, que es cuando<br \/>\nla ocupaci\u00f3n m\u00e1xima en planta baja permitida por ordenanzas no se haya consumido<\/b>.<br \/>\n<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Veamos con un <b style=\"mso-bidi-font-weight: normal;\">ejemplo<\/b> este<br \/>\ncaso:&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Supongamos un solar con 1.200 m2 de parcela en las que las ordenanzas<br \/>\npermiten una ocupaci\u00f3n m\u00e1xima de parcela del 50 %. Sin embargo se dise\u00f1a un<br \/>\nedificio cuya planta baja tiene 400<br \/>\n m2.&nbsp;<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Pues bien, en este caso existir\u00e1 un espacio de 50 % (1200) \u2013 400 = 200 m2 que podr\u00e1 ser<br \/>\ndestinado a jardines privativos de las dos viviendas situadas en la planta Baja<br \/>\ndel bloque, quedando, por ejemplo asignadas en propiedad dos jardines de 120 m2 y 80 m2 cada uno para cada una<br \/>\nde las dos viviendas de planta baja. <\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-size: 20.0pt;\">PATIOS INTERIORES<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">El dise\u00f1o de los patios interiores de un edificio viene impuesto por<br \/>\nnormativa del CTE o por ordenanzas municipales con objeto de conseguir<br \/>\nobjetivos de ventilaci\u00f3n e iluminaci\u00f3n de las diversas estancias de los pisos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Evidentemente <b style=\"mso-bidi-font-weight: normal;\">en los pisos de<br \/>\naltura su uso solo es factible para el uso de tendedero<\/b>, si as\u00ed estuviera<br \/>\npermitido.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Pero <b style=\"mso-bidi-font-weight: normal;\">en la planta baja el patio<br \/>\ntiene en su suelo un espacio utilizable, aunque por definici\u00f3n es zona com\u00fan<\/b>,<br \/>\nsiendo su acceso por el propio portal.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">Pero <b style=\"mso-bidi-font-weight: normal;\">a veces, sucede que, por<br \/>\ndise\u00f1o, el acceso a esa zona de patio es inaccesible, salvo por uno o todos los<br \/>\npisos de planta baja.<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"mso-bidi-font-size: 20.0pt;\">En estos casos <b style=\"mso-bidi-font-weight: normal;\">solo se puede<br \/>\nregular su uso privativo a estos elementos<\/b> debiendo hacerse constar en la<br \/>\nescritura de constituci\u00f3n del r\u00e9gimen de propiedad horizontal la servidumbre de<br \/>\npaso que existe a favor de la comunidad para su inspecci\u00f3n y, arreglo en su<br \/>\ncaso.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Division Horizontal de viviendas con JARD\u00cdN O PATIO en Edificios &nbsp; En general las viviendas situadas en planta baja, adem\u00e1s de tener una superficie inferior a las de plantas de\u2026 <a class=\"continue-reading-link\" href=\"https:\/\/prayde.com\/empresa\/pisos-en-planta-baja-o-con-jardin-o\/\">Continue leyendo<\/a><\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[40,33,21],"class_list":["post-1745","post","type-post","status-publish","format-standard","hentry","category-sin-categoria","tag-division-horizontal","tag-opinion","tag-vivienda"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
