\u2026 de suelo\u201d<\/div>\n<div>&#8211; \u201cSi, pero, \u00bfsuelo bruto, neto, lucrativo, computable, repercusi\u00f3n sobre rasante, bajo rasante \u2026?\u201d (La cara del intermediario va reflejando asombro y desconcierto)<\/div>\n<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Para aclarar este tema tan importante vamos a recordar algunas definiciones b\u00e1sicas<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\">La vigente Ley del Suelo <\/b>estatal dice que<b style=\"mso-bidi-font-weight: normal;\"> <\/b>Todo el suelo se encuentra como <b style=\"mso-bidi-font-weight: normal;\">suelo rural o de suelo urbanizado<\/b><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Se encuentra en la situaci\u00f3n de <b style=\"mso-bidi-font-weight: normal;\">suelo urbanizado<\/b> el que, estando legalmente <b style=\"mso-bidi-font-weight: normal;\">integrado en una malla urbana conformada por una red de viales, dotacione<\/b>s y parcelas, cumpla alguna de las siguientes condiciones<\/div>\n<div style=\"margin-left: 36pt; mso-list: l0 level1 lfo1; text-align: justify; text-indent: -18pt;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span>Haber sido urbanizado<span style=\"mso-spacerun: yes;\"><br \/>\n<\/span><\/div>\n<div style=\"margin-left: 36pt; mso-list: l0 level1 lfo1; text-align: justify; text-indent: -18pt;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-list: Ignore;\">b)<span style=\"font: 7pt 'Times New Roman';\">\u00a0\u00a0\u00a0 <\/span><\/span><\/b><b style=\"mso-bidi-font-weight: normal;\">Tener instaladas y operativas<\/b>, <b style=\"mso-bidi-font-weight: normal;\">las infraestructuras y los servicios necesarios<\/b><\/div>\n<div style=\"margin-left: 36pt; mso-list: l0 level1 lfo1; text-align: justify; text-indent: -18pt;\"><span style=\"mso-list: Ignore;\">c)<span style=\"font: 7pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><b style=\"mso-bidi-font-weight: normal;\">Estar ocupado por la edificaci\u00f3n<\/b><\/div>\n<div class=\"MsoTitle\" style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\">Otros suelos<\/b> se destinan a cubrir las necesidades de los <b style=\"mso-bidi-font-weight: normal;\">Sistemas Generales o Locales<\/b>, para <b style=\"mso-bidi-font-weight: normal;\">Parques, jardines y zonas verdes<\/b>, todas ellas p\u00fablicas y tambi\u00e9n para <b style=\"mso-bidi-font-weight: normal;\">viales y <\/b><b style=\"mso-bidi-font-weight: normal;\">equipamientos p\u00fablicos<\/b><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\">La cesi\u00f3n gratuita <\/b>de estos suelos al municipio <b style=\"mso-bidi-font-weight: normal;\">es una de las cargas urban\u00edsticas que deben soportar <\/b>los propietarios.<b style=\"mso-bidi-font-weight: normal;\"> <\/b>Como contrapartida,<b style=\"mso-bidi-font-weight: normal;\"> los propietarios tienen derecho a suelos edificables<\/b><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\">En el Planeamiento urban\u00edstico, el Sector es el \u00e1mbito m\u00ednimo que se desarrollara <\/b>pormenorizadamente <b style=\"mso-bidi-font-weight: normal;\">mediante<\/b> el <b style=\"mso-bidi-font-weight: normal;\">Plan Parcial .<\/b><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">L\u00f3gicamente <b style=\"mso-bidi-font-weight: normal;\">en la superficie del sector quedan incluidos terrenos de diversos propietarios<\/b><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div class=\"MsoTitle\" style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"font-family: 'Times New Roman','serif'; font-size: 12pt; letter-spacing: 0pt; mso-font-kerning: 0pt;\">Cada sector tendr\u00e1 incluidos una parte de los sistemas generales y locales<\/span><\/b><span style=\"font-family: 'Times New Roman','serif'; font-size: 12pt; letter-spacing: 0pt; mso-font-kerning: 0pt;\"> cuya ejecuci\u00f3n debe asumir como una carga urban\u00edstica. Pero <b style=\"mso-bidi-font-weight: normal;\">adem\u00e1s<\/b> al<br \/>\nsector se le pueden haber <b style=\"mso-bidi-font-weight: normal;\">adscrito sistemas generales que f\u00edsicamente no est\u00e1n ubicados dentro del mismo,<\/b> como una carga urban\u00edstica adicional.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">En consecuencia, <b style=\"mso-bidi-font-weight: normal;\">al considerar la superficie de un determinado sector<\/b>, para el c\u00e1lculo de la edificabilidad m\u00e1xima que le<br \/>\ncorresponde <b style=\"mso-bidi-font-weight: normal;\">hay que distinguir<\/b>:<\/div>\n<div class=\"MsoTitle\" style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">A)<span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>La <b style=\"mso-bidi-font-weight: normal;\">superficie real<\/b>, que es la delimitada por los l\u00edmites topogr\u00e1ficos reales del sector<\/div>\n<div class=\"MsoTitle\" style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">B)<span style=\"mso-tab-count: 1;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><b style=\"mso-bidi-font-weight: normal;\">La superficie computable<\/b> a efectos de calcular la edificabilidad del sector, que es <b style=\"mso-bidi-font-weight: normal;\">la real deduciendo, las superficie de los<br \/>\nsistemas generales adscritos<\/b> al mismo, as\u00ed como todas las superficie de car\u00e1cter p\u00fablico que pudieran existir en su interior,<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Es decir, <b style=\"mso-bidi-font-weight: normal;\">de toda la superficie del sector (bruta), hay que deducir la superficie dedicada a sistemas generales y locales<\/b>, incluyendo viales, <b style=\"mso-bidi-font-weight: normal;\">quedando la superficie neta<\/b>, reflejada en parcelas individualizadas<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\">Dentro de esas parcelas<\/b>, que se han calificado con un uso determinado, parte de la superficie se reserva para retranqueos, patios de<br \/>\nmanzana, zonas verdes de parcela, etc, <b style=\"mso-bidi-font-weight: normal;\">quedando<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>un % de la parcela ocupado por la edificaci\u00f3n, <\/b>en altura o no<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">La <b style=\"mso-bidi-font-weight: normal;\">edificabilidad<\/b> de un terreno se define como <b style=\"mso-bidi-font-weight: normal;\">los m2 de construcci\u00f3n que el planeamiento urban\u00edstico permite realizar <\/b>como m\u00e1ximo en ese determinado suelo.
