diferentes de los de la<br \/>\nComunidad BT\u201d<\/span><\/div>\n<div class=\"MsoNoSpacing\">\n<\/div>\n<div class=\"MsoNoSpacing\">\n<\/div>\n<div class=\"MsoNoSpacing\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-weight: bold;\">Y ha empezado la Comunidad Aut\u00f3noma de las <b>Islas<br \/>\nBaleares<\/b> en la que se publica la<\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\"> <b style=\"mso-bidi-font-weight: normal;\"><a href=\"http:\/\/www.caib.es\/eboibfront\/es\/2014\/8293\/536750\/ley-2-2014-de-25-de-marzo-de-ordenacion-y-uso-del-\">Ley<br \/>\n2\/2014<\/a>, <span style=\"mso-bidi-font-weight: bold;\">de 25 de marzo,<span style=\"mso-spacerun: yes;\">&nbsp;&nbsp; <\/span>de ordenaci\u00f3n y uso del suelo<\/span><\/b><span style=\"mso-bidi-font-weight: bold;\"> que en su art\u00edculo 41-e) supone los<br \/>\nsiguientes <b>porcentajes de reserva de suelo<\/b> para la construcci\u00f3n de <b>Viviendas<\/b><br \/>\nsometidas a alg\u00fan r\u00e9gimen de protecci\u00f3n <b>P\u00fablica<\/b>, estableciendo una<br \/>\nreserva m\u00ednima de suelo del <b>30 %<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>la<br \/>\nedificabilidad residencial prevista en suelo urbanizable, y al 10% en el suelo<br \/>\nurbano<\/b> que deba someterse a actuaciones de reforma o renovaci\u00f3n de la<br \/>\nurbanizaci\u00f3n, respectivamente, siempre que, en ambos casos, el uso residencial<br \/>\nsea el predominante.<\/span><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Reglamentariamente,<br \/>\nel Gobierno de las Illes Balears determinar\u00e1 los municipios y n\u00facleos de<br \/>\npoblaci\u00f3n que, por raz\u00f3n de su poblaci\u00f3n, est\u00e1n obligados a prever esta<br \/>\nreserva. Hasta que no se apruebe esta disposici\u00f3n reglamentaria, quedar\u00e1n<br \/>\nexcluidos de esta reserva los municipios con una poblaci\u00f3n inferior a los 3.000<br \/>\nhabitantes de derecho.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">La<br \/>\nlocalizaci\u00f3n de las zonas de reserva, como regla general, debe ser uniforme<br \/>\npara todos los \u00e1mbitos de actuaci\u00f3n en suelo urbano que est\u00e9n sujetos y en<br \/>\nsuelo urbanizable. <\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Si,<br \/>\nexcepcionalmente, se modifica el reparto uniforme hay que justificar esta<br \/>\ndecisi\u00f3n en la memoria del plan general, bien por raz\u00f3n de la incompatibilidad<br \/>\nde la tipolog\u00eda edificatoria prevista con la construcci\u00f3n de viviendas<br \/>\nprotegidas, bien por raz\u00f3n de la viabilidad de la actuaci\u00f3n en funci\u00f3n de su<br \/>\ndimensi\u00f3n. En todo caso se debe acreditar la inexistencia de concentraci\u00f3n<br \/>\nexcesiva de este tipo de viviendas y la no generaci\u00f3n de segregaci\u00f3n espacial.<br \/>\nDebe procurarse siempre la mezcla de la vivienda de protecci\u00f3n p\u00fablica y la<br \/>\nlibre, y a ser posible hacer coexistir ambos tipos de vivienda en el<br \/>\nterritorio. En cualquier caso, el plan general debe garantizar el cumplimiento<br \/>\n\u00edntegro de la reserva en cuanto a las actuaciones en suelo urbanizable en que<br \/>\nesta reserva les sea exigible.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Sin<br \/>\nperjuicio de lo anterior, <b style=\"mso-bidi-font-weight: normal;\">los<br \/>\nayuntamientos pueden exonerar de la reserva de vivienda<\/b> sometida a alg\u00fan<br \/>\nr\u00e9gimen de protecci\u00f3n p\u00fablica las actuaciones de urbanizaci\u00f3n que se encuentren<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">en alguno de los casos siguientes<\/b>:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7.0pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Que<br \/>\nse ubiquen en una <b style=\"mso-bidi-font-weight: normal;\">zona tur\u00edstica<\/b><br \/>\npara la cual el plan territorial insular determine su reordenaci\u00f3n, y siempre<br \/>\nque esta implique una reducci\u00f3n del aprovechamiento urban\u00edstico respecto del<br \/>\nexistente con anterioridad.<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-bidi-font-size: 12.0pt;\"> del \u00e1mbito de actuaci\u00f3n tenga que <b style=\"mso-bidi-font-weight: normal;\">destinarse a dotaciones p\u00fablicas<\/b> con la<br \/>\nobligatoriedad de los propietarios de ceder gratuitamente los terrenos.<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt; mso-fareast-font-family: Arial;\"><span style=\"mso-list: Ignore;\">d)<span style=\"font: 7.0pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">El<br \/>\nse\u00f1alamiento de las circunstancias en que se debe proceder a su revisi\u00f3n, en<br \/>\nfunci\u00f3n de la poblaci\u00f3n total y su \u00edndice de crecimiento, recursos, usos e<br \/>\nintensidad de ocupaci\u00f3n y otros elementos que justificaron la clasificaci\u00f3n del<br \/>\nsuelo inicialmente adoptada.<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">No obstante<br \/>\nlo anterior en la<br \/>\n Disposici\u00f3n transitoria s\u00e9ptima <b style=\"mso-bidi-font-weight: normal;\">se establece una Moratoria en la aplicaci\u00f3n de la reserva m\u00ednima de<br \/>\nsuelo para vivienda protegida<\/b><\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">De acuerdo<br \/>\ncon lo establecido en la disposici\u00f3n transitoria segunda de la Ley 8\/2013, de 26 de junio, de<br \/>\nrehabilitaci\u00f3n, regeneraci\u00f3n y renovaci\u00f3n urbanas, <b style=\"mso-bidi-font-weight: normal;\">queda en suspenso<\/b> en el \u00e1mbito de la comunidad aut\u00f3noma la<br \/>\nobligatoriedad de fijar reservas de suelo para vivienda protegida prevista en<br \/>\nel art\u00edculo 10.1.b) del texto refundido de la Ley estatal de suelo, aprobado por Real Decreto<br \/>\nLegislativo 2\/2008, de 20 de junio, y en el art\u00edculo 41.e) de la presente ley, <b style=\"mso-bidi-font-weight: normal;\">para aquellas actuaciones<\/b> en las que:<\/span><\/div>\n<div style=\"margin-left: 36.0pt;
