En anteriores publicaciones hemos <b>reclamado al<br \/>\nEstado un esfuerzo de adaptaci\u00f3n a los nuevos tiempos<\/b>, como han hecho todos<br \/>\nlos agentes que intervienen en el sector, y que, en su caso, podr\u00edan centrarse<br \/>\nen <b>disminuir las cargas de cesi\u00f3n de aprovechamiento<\/b>, ya que los costes<br \/>\nde urbanizaci\u00f3n no han bajado tanto como el precio final del suelo edificado y,<br \/>\npor ello, los m\u00e1rgenes han disminuido apreciablemente <\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 10.0pt; mso-bidi-font-size: 11.0pt; mso-bidi-font-weight: bold;\"><\/span><\/div>\n<div class=\"MsoNoSpacing\">\n<\/div>\n<div class=\"MsoNoSpacing\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-weight: bold;\">Seg\u00fan se vayan publicando estas adaptaciones, <b>veremos<br \/>\nde que manera tratan de conjugar estos dos deberes<\/b> y como las primeras CACA<br \/>\nvan a <b>marcar una tendencia<\/b> que acabar\u00e1 \u201ctransmiti\u00e9ndose\u201d de una<br \/>\nComunidad a otra, como ha pasado siempre; eso si, con leves matices, no se vaya<br \/>\na pensar \u201cque los de la Comunidad XZ no somos claramente diferentes de los de<br \/>\nla Comunidad BT\u201d<\/span><\/div>\n<div class=\"MsoNoSpacing\">\n<\/div>\n<div class=\"MsoNoSpacing\">\n<\/div>\n<div class=\"MsoNoSpacing\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-weight: bold;\">Y ha empezado la Comunidad Aut\u00f3noma de las <b>Islas<br \/>\nBaleares<\/b> en la que se publica la<\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\"> <b style=\"mso-bidi-font-weight: normal;\"><a href=\"http:\/\/www.caib.es\/eboibfront\/es\/2014\/8293\/536750\/ley-2-2014-de-25-de-marzo-de-ordenacion-y-uso-del-\">Ley<br \/>\n2\/2014<\/a>, <span style=\"mso-bidi-font-weight: bold;\">de 25 de marzo,<span style=\"mso-spacerun: yes;\">&nbsp;&nbsp; <\/span>de ordenaci\u00f3n y uso del suelo<\/span><\/b><span style=\"mso-bidi-font-weight: bold;\"> que en <\/span><\/span><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">sus<br \/>\nart\u00edculos 32 y 33 y se\u00f1ala, a estos efectos de cesi\u00f3n de aprovechamiento,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>lo siguiente:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Articulo 32<\/span><\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Deberes de las personas propietarias en suelo<br \/>\nurbano<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">3. Cuando la<br \/>\ncompleci\u00f3n de la urbanizaci\u00f3n en suelo urbano requiera de actuaciones<br \/>\nurban\u00edsticas, se deben cumplir los siguientes deberes:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">d. <b style=\"mso-bidi-font-weight: normal;\">Ceder<\/b>, cuando se trate de las<br \/>\nactuaciones previstas en las letras b) o c) del apartado 2 del art\u00edculo 29<br \/>\nmencionado<b style=\"mso-bidi-font-weight: normal;\">, el suelo libre de cargas de<br \/>\nurbanizaci\u00f3n correspondiente al 10% de la edificabilidad media ponderada<\/b><br \/>\nque comporten las diferentes actuaciones. En todo caso, en las actuaciones de<br \/>\ndotaci\u00f3n, las personas propietarias de los terrenos deber\u00e1n ceder este<br \/>\nporcentaje solo sobre el incremento de la edificabilidad media ponderada que<br \/>\ncomporte la actuaci\u00f3n respecto a la anteriormente definida por el planeamiento.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">No obstante<br \/>\nlo anterior, el planeamiento urban\u00edstico puede reducir hasta el 5% este<br \/>\nporcentaje cuando sean actuaciones de transformaci\u00f3n urban\u00edstica vinculadas a<br \/>\nactuaciones de recuperaci\u00f3n o rehabilitaci\u00f3n integral de suelos urbanos,<br \/>\nactuaciones con un exceso de cargas respecto a la media de actuaciones de<br \/>\ntransformaci\u00f3n del municipio, o cuando el \u00e1mbito se destine predominantemente a<br \/>\ndotaciones p\u00fablicas.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Asimismo, el<br \/>\nplaneamiento urban\u00edstico <b style=\"mso-bidi-font-weight: normal;\">puede<br \/>\nincrementar<\/b> de manera justificada el porcentaje previsto anteriormente <b style=\"mso-bidi-font-weight: normal;\">hasta el 20%<\/b> en aquellos casos en que<br \/>\nel valor de las parcelas resultantes sea considerablemente superior al de las<br \/>\notras en la misma<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>categor\u00eda de suelo.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Art\u00edculo 33<\/span><\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Derechos y deberes de las personas<br \/>\npropietarias en suelo urbanizable<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Cuando se<br \/>\ntrate de suelo urbanizable que cuente con ordenaci\u00f3n detallada, las personas<br \/>\npropietarias tienen derecho al porcentaje de aprovechamiento urban\u00edstico del<br \/>\nsector referido a sus fincas que fije el planeamiento.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">2. Las<br \/>\npersonas propietarias de suelo urbanizable tienen, adem\u00e1s de los deberes<br \/>\nprevistos en el art\u00edculo 32.3 de esta ley que sean propios de su clase de suelo,<br \/>\nlos siguientes:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">b. <b style=\"mso-bidi-font-weight: normal;\">Ceder el suelo libre de cargas de<br \/>\nurbanizaci\u00f3n correspondiente al 15% de la edificabilidad media ponderada<\/b><br \/>\nque impliquen las diferentes actuaciones. De forma justificada, este porcentaje<br \/>\npuede reducirse por el planeamiento urban\u00edstico hasta el 5% cuando sean<br \/>\nactuaciones con un exceso de cargas respecto a la media de actuaciones de<br \/>\ntransformaci\u00f3n del municipio, o cuando el \u00e1mbito se destine predominantemente a<br \/>\ndotaciones p\u00fablicas.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">Desde nuestro blog, NO aplaudimos los porcentajes<br \/>\nde cesi\u00f3n<\/span><\/b><span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">, generalmente en<br \/>\nlas Islas Baleares, superaran con creces los m\u00e1rgenes de la iniciativa privada<br \/>\nen la mayor parte de los casos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-family: &quot;Arial&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; mso-bidi-font-size: 12.0pt;\">El<br \/>\nlegislador urbanista parece olvidar que el proceso de transformaci\u00f3n de suelo<br \/>\nes:<\/span><\/div>\n<ul style=\"margin-top: 0cm;\" type=\"disc\">\n<li style=\"mso-list: l0 level1 lfo1;
