style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Los Estatutos de una Comunidad de Propietarios, tambi\u00e9n llamados<br \/>\nEstatutos de <b style=\"mso-bidi-font-weight: normal;\">R\u00e9gimen Interior<\/b>,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>son los que rigen el uso de los elementos<br \/>\ncomunes de dicha comunidad como son: fachada, portal, escalera, ascensores,<br \/>\ncubierta, jardines, piscinas, parques de juegos de ni\u00f1os, polideportivos,<br \/>\ntenis, p\u00e1del y dem\u00e1s elementos comunitarios.<\/span><\/p>\n<div class=\"separator\" style=\"clear: both; text-align: center;\">\n<a href=\"https:\/\/1.bp.blogspot.com\/-ibLRb_iZ6e0\/XuHdNZ8Pk3I\/AAAAAAAAAjQ\/wLzpQJUTYswWBxIFRtOeIteanxnwjqDygCLcBGAsYHQ\/s1600\/jace-afsoon-3-_02iJ_-zA-unsplash.jpg\" imageanchor=\"1\" por cierto, que sean redactados por<br \/>\nel promotor, siendo el momento mas adecuado para ello, incorporarlos en la<br \/>\npropia escritura de divisi\u00f3n horizontal ya que de esta manera no devengan impuestos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Ahora bien el promotor debe circunscribirse, seg\u00fan sea la complejidad<br \/>\nde la comunidad o del complejo inmobiliario en cuesti\u00f3n, a regular aquellos<br \/>\naspectos que pudieran ser contraproducentes para su propia comercializaci\u00f3n de<br \/>\notros elementos del edificio que no sean viviendas o de sucesivas fases de la<br \/>\npromoci\u00f3n cuyas se\u00f1as de identidad conviene respetar.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Por ejemplo conviene que queden regulados perfectamente la prohibici\u00f3n,<br \/>\nen su caso, de acceso de los due\u00f1os de los locales comerciales a los jardines y<br \/>\npiscinas comunitarias, pero si conviene, a veces, que se regule su acceso por<br \/>\nel portal y escaleras para llegar a la cubierta y poder instalar o reparar<br \/>\nelementos de aire acondicionado o chimeneas de ventilaci\u00f3n que fueran<br \/>\nobligatorios para desarrollar su actividad que puede no estar prevista en la<br \/>\nconstrucci\u00f3n, pero no debe ser limitaci\u00f3n para su libre comercializaci\u00f3n, todos<br \/>\nellos de gran inter\u00e9s para el promotor inmobiliario.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Con respecto a las distintas fases a construir con posterioridad el<br \/>\npromotor ser\u00e1 el primer interesado en guardar la est\u00e9tica de fachadas y de<br \/>\ntoldos sobrevenidos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Tambi\u00e9n deben ser regulados aquellos aspectos legales que sean de<br \/>\nobligado cumplimiento remiti\u00e9ndose a las leyes u ordenanzas municipales como<br \/>\nson el ruido, el paseo de perros, etc.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-size: 11.0pt;\"><\/span><\/b><br \/>\n<!--more--><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"font-size: 11.0pt;\">En el caso de <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>UN COMPLEJO INMOBILIARIO, c<\/span><\/b><span lang=\"ES\" style=\"font-size: 11.0pt;\">omo ya hemos se\u00f1alado estos casos presentan<br \/>\nuna gran complejidad y operan de distinta manera que en un edificio.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Pongamos por ejemplo un complejo inmobiliario compuesto por varios<br \/>\nedificios distintos con una zona com\u00fan.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Lo normal en este caso es que existan una Comunidad de Propietarios por<br \/>\ncada edificio y una Comunidad General que agrupe el funcionamiento de los<br \/>\nelementos comunes.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Cada propietario tendr\u00e1 pues, dos cuotas de participaci\u00f3n, generalmente<br \/>\ndistintas, que deber\u00e1n constar en la Divisi\u00f3n Horizontal: una correspondiente<br \/>\nal propio edificio y otra de participaci\u00f3n de zonas comunes.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Pues bien, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>el promotor deber\u00e1<br \/>\nredactar unos Estatutos para el funcionamiento de cada edificio pero limitando<br \/>\nalgunos aspectos al sometimiento a los de la Comunidad General.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">En este caso, por ejemplo, nada impedir\u00eda que el interior del portal<br \/>\nfuera dise\u00f1ado libremente por cada comunidad de cada edificio con la limitaci\u00f3n<br \/>\nde que no quedase afectado su exterior.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"font-size: 11.0pt;\">Este puede ser, por ejemplo, el caso de chales adosados que comparten<br \/>\nuna zona com\u00fan interior. Evidentemente, las fachadas y la cubierta de cada<br \/>\nchalet, as\u00ed como el muro que los separa de la zona com\u00fan con acceso a ella, son<br \/>\nelementos privativos de cada uno de ellos, ya que si por ejemplo en un chalet<br \/>\nse presentan goteras en su cubierta el arreglo de las mismas corresponde a el y<br \/>\nno a la comunidad.
