auton\u00f3mica<\/b> de Ordenaci\u00f3n del Territorio y de<br \/>\nUrbanismo <b style=\"mso-bidi-font-weight: normal;\">se van estableciendo ajustes<br \/>\nderivados de la necesidad de poner freno al un tanto \u201cdemencial \u201cproceso<br \/>\nurbanizador<\/b> que ha habido en Espa\u00f1a en la d\u00e9cada 1997-2007, <b style=\"mso-bidi-font-weight: normal;\">poniendo trabas a que todo suelo rustico<br \/>\nprotegido por causas objetivas sea urbanizable<\/b>, haci\u00e9ndose fuerte en<br \/>\nconsideraciones de necesidad desde el punto de vista de la sostenibilidad<br \/>\necon\u00f3mica y medio ambiental, etc.<\/p>\n<div class=\"separator\" style=\"clear: both; text-align: center;\">\n<a justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nLa palabra <b style=\"mso-bidi-font-weight: normal;\">sostenibilidad econ\u00f3mica no se refiere, desgraciadamente, hacia el<br \/>\npromotor, sino hacia los Ayuntamientos<\/b>, para hacerles conscientes de las<br \/>\nnuevos servicios a prestar y sus posibilidades presupuestarias, <b style=\"mso-bidi-font-weight: normal;\">pero el modelo econ\u00f3mico se mantiene y, en<br \/>\nciertos casos se endurece sensiblemente.<\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">El legislador no tiene en cuenta, en absoluto, el entorno econ\u00f3mico<br \/>\nexistente en la actualidad,<\/b> ya que <b style=\"mso-bidi-font-weight: normal;\">desde<br \/>\n2006<\/b> punto m\u00e1s elevado del boom, el sector entra en una profunda depresi\u00f3n<br \/>\nque se mantiene hasta el momento<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">Los precios de venta de las viviendas bajan alrededor de un 50 % de<br \/>\nmedia y el valor de repercusi\u00f3n del suelo un 70 %,<\/b> pero eso no es lo m\u00e1s<br \/>\nsignificativo, sino que <b style=\"mso-bidi-font-weight: normal;\">apenas existen<br \/>\nactuaciones urban\u00edsticas de transformaci\u00f3n de suelo.<\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<p><!--more--><\/p>\n<div style=\"text-align: justify;\">\nLa situaci\u00f3n se percibe de forma<br \/>\nnotoria, pero <b style=\"mso-bidi-font-weight: normal;\">nadie ataca la ra\u00edz del<br \/>\nasunto<\/b> y, las consecuencias son claras para el presupuesto de los<br \/>\nayuntamientos, por un lado, y por la necesidad de desarrollo de las ciudades dot\u00e1ndolas<br \/>\nde equipamientos p\u00fablicos, amplios viales y zonas ajardinadas cuyo motor de<br \/>\nejecuci\u00f3n era el sector privado.&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nPero es m\u00e1s, <b style=\"mso-bidi-font-weight: normal;\">se da la paradoja, de que en muchos Ayuntamientos, no pueden mantener<br \/>\nlos est\u00e1ndares de parques, jardines, etc., cuyas superficies m\u00ednimas est\u00e1n<br \/>\nregladas por ley<\/b>.<\/div>\n<div style=\"text-align: justify;\">\nNosotros <b style=\"mso-bidi-font-weight: normal;\">hemos abogado repetidamente por asumir que al modelo hay que aplicarle<br \/>\nla situaci\u00f3n real del entrono econ\u00f3mico en que estamos inmersos<\/b>. Pero nadie<br \/>\nnos escucha y, cada vez, <b style=\"mso-bidi-font-weight: normal;\">observamos con<br \/>\nsorpresa que las condiciones se endurecen m\u00e1s y m\u00e1s<\/b>. Sucede algo parecido<br \/>\ncon la Valoraci\u00f3n Catastral,<br \/>\nque los Ayuntamientos la siguen elevando o, los menos, manteniendo en niveles<br \/>\nde 2007, cuando la baja de valor en los inmuebles urbanos es evidente y la<br \/>\nvaloraci\u00f3n catastral se muestra insostenible.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\nPero a diferencia de lo que<br \/>\nocurre con el IBI, <b style=\"mso-bidi-font-weight: normal;\">en el modelo del<br \/>\nsuelo existen v\u00edas alternativas de soluci\u00f3n:<\/b> si se quiere mantener los<br \/>\nest\u00e1ndares de calidad urbana, estos, por un lado son muchos y se puede<br \/>\npriorizar el mantenimiento de algunos y la rebaja de otros que puedan producir<br \/>\nproblemas presupuestarios o bien, <b style=\"mso-bidi-font-weight: normal;\">tenemos<br \/>\ndos alternativas m\u00e1s: rebajar al l\u00edmite inferior (5%) la cesi\u00f3n de<br \/>\naprovechamiento y tambi\u00e9n rebajar<\/b> y, desde luego poner en sinton\u00eda, <b style=\"mso-bidi-font-weight: normal;\">la desaparici\u00f3n de la financiaci\u00f3n estatal<br \/>\npara las VPO con los porcentajes exigidos como m\u00ednimo (50%).<\/b> En este<br \/>\nsentido la \u00faltima reforma de la<br \/>\n Ley del Suelo Estatal ha sido claramente t\u00edmida e<br \/>\ninsuficiente.<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">Sin este an\u00e1lisis<\/b> que, principalmente deben realizar las CCAA de<br \/>\nmodificaci\u00f3n valiente y sustancial del modelo econ\u00f3mico, no del resto de<br \/>\nrequisitos medio ambientales que consideramos correctos, <b style=\"mso-bidi-font-weight: normal;\">no se resolver\u00e1 el problema de fluidez en el desarrollo urban\u00edstico de<br \/>\nlas ciudades espa\u00f1olas.<\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\">EJEMPLO LEGISLATIVO DE LA EVOLUCI\u00d3N DEL MODELO ECON\u00d3MICO DE<br \/>\nTRANSFORMACI\u00d3N URBAN\u00cdSTICA DEL SUELO<\/b><\/div>\n<div style=\"text-align: justify;\">\nEn desarrollo de lo se\u00f1alado,<br \/>\nrespecto al modelo econ\u00f3mico de transformaci\u00f3n urban\u00edstica del suelo, elegimos<br \/>\nla normativa del Pa\u00eds Vasco:<\/div>\n<div style=\"line-height: normal;
