provocando peticiones adicionales de solvencia que,<br \/>\nparticularmente en el caso de Cooperativas, hacen pr\u00e1cticamente inviable este<br \/>\ntipo de operaciones, sobre todo en su arranque<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">Afortunadamente, este gobierno que<br \/>\nno para de legislar y que, con ello, esta transformando Espa\u00f1a, pero que ha<br \/>\ndecidido que no hace falta cont\u00e1rselo a nadie (<i style=\"mso-bidi-font-style: normal;\">Por la boca muere el pez<\/i>; en este caso por tenerla cerrada) ha<br \/>\nvenido a poner un poco de racionalidad con lo siguiente<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<h3 style=\"text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">Se ha publicado<br \/>\nla<span style=\"mso-spacerun: yes;\">&nbsp; <\/span><\/span><span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-family: Arial; mso-bidi-font-size: 11.0pt; mso-fareast-font-family: &quot;Times Roman&quot;; mso-fareast-language: ES-TRAD;\">Obligaciones de los promotores que perciban<br \/>\ncantidades anticipadas<\/span><\/div>\n<div style=\"text-align: justify;\">\n<i><span Las personas f\u00edsicas y jur\u00eddicas que<br \/>\npromuevan la construcci\u00f3n de toda clase de viviendas, incluidas las que se<br \/>\nrealicen en r\u00e9gimen de comunidad de propietarios o sociedad cooperativa, y que<br \/>\npretendan obtener de los adquirentes entregas de dinero para su construcci\u00f3n,<br \/>\ndeber\u00e1n cumplir las condiciones siguientes:<\/span><\/i><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<h3 style=\"text-align: justify;\">\n<i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;;\">a)<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">Garantizar<\/b>, <\/span><\/i><b><i><span style=\"color: #943634; font-family: &quot;calibri&quot; , &quot;sans-serif&quot;; font-size: 16.0pt;\">desde la obtenci\u00f3n de la licencia de edificaci\u00f3n<\/span><\/i><\/b><i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;;\">, <b style=\"mso-bidi-font-weight: normal;\">la devoluci\u00f3n de las cantidades entregadas <\/b>&nbsp;<\/span><\/i><\/h3>\n<div style=\"text-align: justify;\">\n<i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;;\">m\u00e1s los intereses<br \/>\nlegales, mediante contrato de seguro de cauci\u00f3n suscrito con entidades<br \/>\naseguradoras debidamente autorizadas para operar en Espa\u00f1a, o mediante aval<br \/>\nsolidario emitido por entidades de cr\u00e9dito debidamente autorizadas, <\/span><\/i><i><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #943634; font-family: &quot;calibri&quot; , &quot;sans-serif&quot;; font-size: 14.0pt;\">para el caso de que la<br \/>\nconstrucci\u00f3n no se inicie o no llegue a buen fin en el plazo convenido<\/span><\/b><\/i><i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;; font-size: 14.0pt;\"><br \/>\n<\/span><\/i><i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;;\">para la<br \/>\nentrega de la vivienda.<\/span><\/i><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<b><i><span style=\"font-family: &quot;calibri&quot; , &quot;sans-serif&quot;; font-weight: normal;\">b) Percibir las cantidades<br \/>\nanticipadas por los adquirentes a trav\u00e9s de entidades de cr\u00e9dito en las que<br \/>\nhabr\u00e1n de depositarse en cuenta especial, con separaci\u00f3n de cualquier otra<br \/>\nclase de fondos pertenecientes al promotor, incluido el supuesto de comunidades<br \/>\nde propietarios o sociedad cooperativa, y de las que \u00fanicamente podr\u00e1 disponer<br \/>\npara las atenciones derivadas de la construcci\u00f3n de las viviendas. Para la<br \/>\napertura de estas cuentas o dep\u00f3sitos la entidad de cr\u00e9dito, bajo su<br \/>\nresponsabilidad, exigir\u00e1 la garant\u00eda a que se refiere la condici\u00f3n anterior<\/span><\/i><\/b><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">Dos. Requisitos de las garantias<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">\u2026<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">b) La suma asegurada incluir\u00e1 <b style=\"mso-bidi-font-weight: normal;\">la<br \/>\ncuant\u00eda total de las cantidades anticipadas en el contrato de compraventa, de<br \/>\nadhesi\u00f3n a la promoci\u00f3n o fase de la cooperativa o instrumento jur\u00eddico<br \/>\nequivalente,<\/b> incluidos los impuestos aplicables, incrementada en el inter\u00e9s<br \/>\nlegal del dinero desde la entrega efectiva del anticipo hasta la fecha prevista<br \/>\nde la entrega de la vivienda por el promotor<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-size: 12.0pt; line-height: 115%; mso-bidi-font-size: 11.0pt;\">h) <b style=\"mso-bidi-font-weight: normal;\">En caso de que la construcci\u00f3n<br \/>\nno se inicie o no llegue a buen fin en el plazo <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>convenido el asegurado<\/b>, siempre que haya<br \/>\nrequerido de manera fehaciente al <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>promotor<br \/>\npara la devoluci\u00f3n de las cantidades aportadas a cuenta, incluidos los <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>impuestos aplicables y sus intereses y este en<br \/>\nel plazo de treinta d\u00edas no haya <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>procedido<br \/>\na su devoluci\u00f3n, podr\u00e1 reclamar al asegurador el abono de la indemnizaci\u00f3n <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>correspondiente.
