114%;\">Pero<br \/>\nno solamente hay que tener en cuenta la LOE. \/>\nDEL PROMOTOR<\/span><\/b><span lang=\"ES\" style=\"font-size: 11.0pt; line-height: 114%;\"><br \/>\n<\/span><\/h3>\n<div style=\"text-align: justify;\">\n<\/div>\n<p><!--more--><\/p>\n<h4 style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #17365d; font-size: 14.0pt; line-height: 114%;\">DERIVADAS DEL C\u00d3DIGO CIVIL<\/span><\/b><\/h4>\n<div style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">El<br \/>\ncontratista de un edificio que se arruinase por vicios de la construcci\u00f3n,<br \/>\nresponde de los da\u00f1os y perjuicios<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> si la ruina tuviere lugar dentro de<br \/>\ndiez a\u00f1os, contados desde que concluy\u00f3 la construcci\u00f3n; igual responsabilidad,<br \/>\ny por el mismo tiempo, tendr\u00e1 el arquitecto que la dirigiere, si se debe la<br \/>\nruina a vicio del suelo o de la direcci\u00f3n. <\/span><\/div>\n<div>\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">A la vista de todo este articulado <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">la<br \/>\ndoctrina jurisprudencial viene considerando que la aplicaci\u00f3n de las<br \/>\nresponsabilidades del articulo 1591 el promotor inmobiliario es responsable<br \/>\nsolidario con el contratista y el arquitecto desde antes de la aparici\u00f3n de la<br \/>\nLOE<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<h4 style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #17365d; font-size: 14.0pt; line-height: 114%;\">DERIVADAS DE LA NORMATIVA DE SEGURIDAD Y SALUD <\/span><\/b><\/h4>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">La materia viene regulada por la Ley 31\/1995 de 8 de noviembre<br \/>\ny el Real<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>Decreto 1627\/1997, que la<br \/>\ndesarrolla, siendo a nuestros efectos de se\u00f1alar el siguiente articulado:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">Art\u00edculo 1.1. c) considera, a efectos de<br \/>\nesta ley, que el Promotor: <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">cualquier<br \/>\npersona f\u00edsica o jur\u00eddica por cuenta de la cual se realice una obra<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">.<\/span><\/div>\n<div>\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">Como es l\u00f3gico una definici\u00f3n muy centrada en las relaciones<br \/>\ncontractuales entre el promotor y los dem\u00e1s agentes de la edificaci\u00f3n,<br \/>\nincluyendo los coordinadores en materia de seguridad y salud<\/span><\/div>\n<div style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 18.0pt; margin-right: 0cm; margin-top: 0cm; mso-list: l2 level1 lfo3; text-align: justify; text-indent: -18.0pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: font-size: 11.0pt;\">Cuando en la elaboraci\u00f3n del<br \/>\nproyecto de obra intervengan varios proyectistas, <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt;\">el promotor<br \/>\ndesignar\u00e1 un coordinador en materia de seguridad y de salud durante la<br \/>\nelaboraci\u00f3n del proyecto de obra.<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"line-height: normal; margin-bottom: .0001pt; margin-bottom: 0cm; margin-left: 18.0pt; margin-right: 0cm; margin-top: 0cm; mso-list: l2 level1 lfo3; text-align: justify; text-indent: -18.0pt;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt;\"><span style=\"mso-list: Ignore;\">2.<span style=\"font: 7.0pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp; <\/span><\/span><\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt;\">Cuando en la ejecuci\u00f3n de la<br \/>\nobra intervenga m\u00e1s de una empresa, o una empresa y trabajadores aut\u00f3nomos o<br \/>\ndiversos trabajadores aut\u00f3nomos, el <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt;\">promotor<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt;\">, antes del inicio de los<br \/>\ntrabajos o tan pronto como se constate dicha circunstancia, designar\u00e1 un <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt;\">coordinador en materia de seguridad y salud durante la ejecuci\u00f3n<br \/>\nde la obra.<\/span><\/b><\/div>\n<div>\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<h4 style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #17365d; font-size: 14.0pt; line-height: 114%;\">DERIVADAS DE LA LOE<\/span><\/b><\/h4>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">La citada LOE a nivel nacional, se<br \/>\nencarga de dibujar jur\u00eddicamente, la figura del promotor de una forma mas<br \/>\nacabada que en la definici\u00f3n anterior y, as\u00ed en<span style=\"mso-spacerun: yes;\">&nbsp;<br \/>\n<\/span>el<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>art\u00edculo 9.1 de la LOE, se considera <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">promotor toda persona f\u00edsica o jur\u00eddica,<br \/>\npublica o privada, que individual o colectivamente, decide,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>impulsa, programa y financia con recursos<br \/>\npropios o ajenos, las obras de edificaci\u00f3n para si o para su posterior enajenaci\u00f3n<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">, entrega o<br \/>\ncesi\u00f3n a terceros bajo cualquier titulo <\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">De<br \/>\nesta definici\u00f3n cabe destacar los siguientes aspectos:<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; de obra, para la formalizaci\u00f3n de los<br \/>\ncorrespondientes tr\u00e1mites administrativos.<\/span><\/b><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">Hay que tener en cuenta que <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">el contenido detallado del Libro del Edificio,<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> quienes est\u00e1n<br \/>\nobligados a su elaboraci\u00f3n y a quien debe entregarse <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">es competencia de las edificio<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> o de parte del mismo, ya sea de nueva<br \/>\nconstrucci\u00f3n o existente, <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">ser\u00e1 el<br \/>\nresponsable de encargar la realizaci\u00f3n de la certificaci\u00f3n<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> de eficiencia<br \/>\nenerg\u00e9tica del edificio, o de su parte, en los casos que venga obligado por<br \/>\neste real decreto. <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Tambi\u00e9n ser\u00e1<br \/>\nresponsable de conservar la correspondiente documentaci\u00f3n<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">) <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Certificado<br \/>\nde eficiencia energ\u00e9tica del proyecto<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">: documentaci\u00f3n suscrita por el<br \/>\nproyectista como resultado del proceso de certificaci\u00f3n, que contiene<br \/>\ninformaci\u00f3n sobre las caracter\u00edsticas energ\u00e9ticas y la calificaci\u00f3n de<br \/>\neficiencia energ\u00e9tica del proyecto de ejecuci\u00f3n.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">f) <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Certificado<br \/>\nde eficiencia energ\u00e9tica del edificio terminado<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">: documentaci\u00f3n<br \/>\nsuscrita por la direcci\u00f3n facultativa del edificio por el que se verifica la<br \/>\nconformidad de las caracter\u00edsticas energ\u00e9ticas y la calificaci\u00f3n de eficiencia<br \/>\nenerg\u00e9tica obtenida por el proyecto de ejecuci\u00f3n con la del edificio terminado.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<h4 style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #17365d; font-size: 14.0pt; line-height: 114%;\">DERIVADAS DE LA<br \/>\n  LEY DE REHABILITACI\u00d3N<\/span><\/b><\/h4>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">Son obligaciones derivadas del hecho de<br \/>\nque<b style=\"mso-bidi-font-weight: normal;\"> un promotor que realiza <\/b><\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">promociones para arrendamiento mantener el mismo <\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">como se\u00f1alan las leyes auton\u00f3micas de<br \/>\nOrdenaci\u00f3n de Territorio y Urbanismo de las CCAA y tambi\u00e9n la LOE en su art\u00edculo 16.1<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">El <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Informe<br \/>\nde Evaluaci\u00f3n<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> de los Edificios.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">1. <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Los<br \/>\npropietarios de inmuebles<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> ubicados en edificaciones con tipolog\u00eda<br \/>\nresidencial de vivienda colectiva podr\u00e1n ser requeridos por la Administraci\u00f3n<br \/>\ncompetente, de conformidad con lo dispuesto en la disposici\u00f3n transitoria<br \/>\nprimera, para que <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">acrediten la situaci\u00f3n<br \/>\nen la que se encuentran<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> aqu\u00e9llos, al menos en relaci\u00f3n con <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">el estado de conservaci\u00f3n del edificio<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> y con el<br \/>\ncumplimiento de la normativa vigente sobre accesibilidad universal, as\u00ed como<br \/>\nsobre el grado de eficiencia energ\u00e9tica de los mismos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\">1. <\/span><b style=\"mso-bidi-font-weight: normal;\"><span lang=\"ES\" style=\"color: #c0504d; font-size: 11.0pt; line-height: 114%;\">Cuando<br \/>\nun edificio se venda o alquile, antes de su construcci\u00f3n, el vendedor o<br \/>\narrendador facilitar\u00e1 su calificaci\u00f3n energ\u00e9tica de proyecto<\/span><\/b><span lang=\"ES\" style=\"color: #17365d; font-size: 11.0pt; line-height: 114%;\"> expidi\u00e9ndose<br \/>\nel certificado del edificio terminado una vez construido el edificio.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span lang=\"ES\" style=\"color: #17365d; font-size:
