font-size: 10.0pt; line-height: 114%;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\"> estudiar una promoci\u00f3n inmobiliaria<\/span><\/b>, con <\/span><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">el conjunto de <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">riesgos<\/span><\/b> <b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">que hay que contemplar <\/span><\/b><\/p>\n<p><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">No abarca \u00fanicamente<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> los riesgos derivados de la imputaci\u00f3n de <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">costes<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> necesarios para llevara cabo dicha promoci\u00f3n, en cuanto a que una <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">desviaci\u00f3n de los mismos<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> produzca una disminuci\u00f3n del beneficio esperado, que podr\u00e1 llegar incluso a que la operaci\u00f3n ente en perdidas<\/span><\/p>\n<div style=\"text-align: justify;\">\n<div class=\"separator\" style=\"clear: both; font-size: 12.0pt; line-height: 114%;\">El Promotor tiene que asumir una serie de responsabilidades<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">\u00a0<\/span><\/h3>\n<div style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">\u00a0derivadas de su actividad, que podemos circunscribir en dos planos distintos:<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l0 level1 lfo2; text-align: justify; text-indent: -18.0pt;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7.0pt 'Times New Roman';\"> \u00a0\u00a0\u00a0 <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">Como agente de la edificaci\u00f3n<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> seg\u00fan la LOE<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l0 level1 lfo2; text-align: justify; text-indent: -18.0pt;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"><span style=\"mso-list: Ignore;\">b)<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0 <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">Como perceptor de cantidades a cuenta<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> en el caso de recibir cantidades a cuenta, antes de la entrega, en el caso de promociones de viviendas.<\/span><\/div>\n<div style=\"margin-left: 36.0pt; mso-list: l0 level1 lfo2; text-align: justify; text-indent: -18.0pt;\">\n<span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">En el primer caso, nos encontramos con la<\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\"> Responsabilidad civil <\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"><span style=\"mso-spacerun: yes;\">\u00a0<\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">frente a los propietarios<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> y los terceros adquirentes de los edificios o parte de los mismos, en el caso de que sean objeto de divisi\u00f3n, de los siguientes <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">da\u00f1os materiales ocasionados al edificio<\/span><\/b><\/div>\n<div><\/div>\n<div style=\"margin-left: 18.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\"><span style=\"color: #17365d; font-family: 'symbol'; font-size: 10.0pt; line-height: 114%;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">Durante diez a\u00f1os, <\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">de los da\u00f1os materiales causados en el edificio por vicios o defectos que afecten a la <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">cimentaci\u00f3n<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">, los soportes, las vigas, los forjados, los muros de carga u otros <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">elementos estructurales<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> y que comprometan la resistencia mec\u00e1nica y la estabilidad del edificio.<\/span><\/div>\n<div style=\"margin-left: 18.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\"><span style=\"color: #17365d; font-family: 'symbol'; font-size: 10.0pt; line-height: 114%;\"><span style=\"mso-list: Ignore;\">\u00b7<span style=\"font: 7.0pt 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">Durante tres a\u00f1os<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">, de los da\u00f1os materiales causados en el edificio por <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">vicios o defectos de los elementos constructivos o de las instalaciones <\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">que ocasionen el incumplimiento de los requisitos de habitabilidad del apartado 1, letra c) del articulo 3.<\/span><\/div>\n<div style=\"margin-left: 18.0pt; mso-list: l1 level1 lfo1; text-align: justify; text-indent: -18.0pt;\"><\/div>\n<h2 style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">En todo caso el promotor responder\u00e1 solidariamente <\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">con los dem\u00e1s agentes intervinientes<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>ante los adquirentes <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">por da\u00f1os materiales ocasionados por vicios o defectos de construcci\u00f3n.<\/span><\/b><\/h2>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">La <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">responsabilidad<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> del promotor a que se refiere esta Ley <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">se extender\u00e1 a<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> las personas f\u00edsicas o jur\u00eddicas que, a tenor del contrato y de<br \/>\nsu intervenci\u00f3n en la promoci\u00f3n, <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">act\u00faen como tales promotores bajo la forma de promotor o gestor de cooperativas<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> o de comunidades de propietarios u otras figuras<span style=\"mso-spacerun: yes;\">\u00a0\u00a0<\/span><\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">En un segundo apartado, nos encontramos con las garant\u00edas que se deben aportar\u00a0 <\/span><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">sobre <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">percepci\u00f3n<\/span><\/b> <b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">de cantidades anticipadas en<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"> la construcci\u00f3n y venta de viviendas, se cubrir\u00e1 mediante un seguro que indemnice el incumplimiento del contrato en forma an\u00e1loga a lo dispuesto, a estos efectos, en la <b style=\"mso-bidi-font-weight: normal;\">Disposici\u00f3n<\/b><b style=\"mso-bidi-font-weight: normal;\"> adicional primera de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1999-21567\" target=\"_blank\" rel=\"noopener\">LOE<\/a>:<\/b><\/span><\/div>\n<h3 style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\"><b style=\"mso-bidi-font-weight: normal;\"><br \/>\nPercepci\u00f3n de cantidades a cuenta del precio durante la construcci\u00f3n <\/b><\/span><\/h3>\n<div style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">a) La expresada normativa ser\u00e1 de aplicaci\u00f3n a la <\/span><b style=\"mso-bidi-font-weight: normal;\"><span style=\"color: #c0504d; font-size: 12.0pt; line-height: 114%;\">promoci\u00f3n de toda clase de viviendas<\/span><\/b><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">, incluso a las que se realicen en r\u00e9gimen de comunidad de propietarios o sociedad cooperativa.<\/span><\/div>\n<div style=\"text-align: justify;\"><span style=\"color: #17365d; font-size: 10.0pt; line-height: 114%;\">c) La devoluci\u00f3n garantizada comprender\u00e1 las cantidades entregadas m\u00e1s los intereses legales del dinero vigentes hasta el momento en que se haga efectiva la devoluci\u00f3n.<\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<h3 style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"color: #17365d; font-family: 'gill sans mt' , 'sans-serif'; font-size: 10.0pt;\">Estos temas, que por su importancia <\/span><span lang=\"ES-TRAD\" style=\"color: #17365d; font-family: 'gill sans mt' , 'sans-serif'; font-size: 10.0pt; font-weight: normal;\">desde el punto de vista legal, requieren de un tratamiento con mas profundidad,<\/span><span lang=\"ES-TRAD\" style=\"color: #17365d; font-family: 'gill sans mt' , 'sans-serif';
