style=\"mso-bidi-font-weight: normal;\">del Pais Vasco<\/b> (Ley del Suelo y Urbanismo del Pa\u00eds Vasco) que,<br \/>\npensamos, <b style=\"mso-bidi-font-weight: normal;\">est\u00e1 marcando una tendencia<\/b><\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\">En<br \/>\nla <b style=\"mso-bidi-font-weight: normal;\">reciente Ley 3\/2015<\/b> de 18 de<br \/>\njunio, de la<span style=\"mso-spacerun: yes;\">&nbsp; <\/span><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2015-7802\">Vivienda del<br \/>\nPa\u00eds Vasco<\/a>, concretamente en su art\u00edculo 27.1 se recoge una excelente <b style=\"mso-bidi-font-weight: normal;\">novedad al respecto del precio de<br \/>\nrepercusi\u00f3n del suelo,<\/b> aunque todav\u00eda hay que esperar al desarrollo<br \/>\nreglamentario que lo concrete:<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div class=\"articulo\" style=\"text-align: justify;\">\n<b style=\"mso-bidi-font-weight: normal;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Art\u00edculo 27. El precio de los<br \/>\nsuelos que se destinen a la promoci\u00f3n de vivienda de protecci\u00f3n p\u00fablica, en<br \/>\ncualquiera de sus tipolog\u00edas relacionadas en el art\u00edculo 21 de la presente ley,<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">deber\u00e1 respetar los valores m\u00e1ximos de repercusi\u00f3n<br \/>\ntanto de suelo como de urbanizaci\u00f3n<\/b> establecidos por sus normativas<br \/>\nprotectoras respectivas.<\/span><\/i><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\">Es<br \/>\ndecir da un paso adelante en la direcci\u00f3n de limitar por separado no solo el<br \/>\nprecio del suelo sino tambi\u00e9n el de la urbanizaci\u00f3n.<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\">Esperemos<br \/>\nque se confirmen nuestras apreciaciones.<\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\"><span style=\"mso-spacerun: yes;\">&nbsp;<\/span>En la misma ley se desarrolla la figura de los<br \/>\n<b style=\"mso-bidi-font-weight: normal;\">ALOJAMIENTOS DOTACIONALES<\/b>,<br \/>\nconcretamente en su art\u00edculo 23 <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>cuya dotaci\u00f3n<br \/>\nobligatoria ya estaba recogida en la<br \/>\n Ley del Suelo del Pa\u00eds vasco para todos los sectores urban\u00edsticos<br \/>\nde uso residencial. <\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\">Esta<br \/>\nfigura proporciona una <b style=\"mso-bidi-font-weight: normal;\">herramienta a las<br \/>\nAdministraciones para intervenir en el mercado de la vivienda, limit\u00e1ndose, eso<br \/>\ns\u00ed, al alquiler, pero utilizando suelo dotacional<\/b> y no calificado como<br \/>\nresidencial. Esta puede ser una via que se explore por otras CACA en el futuro <\/span><\/div>\n<div style=\"margin-bottom: .0001pt; margin-bottom: 0cm; text-align: justify;\">\n<\/div>\n<div class=\"articulo\">\n<b style=\"mso-bidi-font-weight: normal;\"><i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">Art\u00edculo<br \/>\n23. Alojamientos dotacionales<\/span><\/i><\/b><i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">.<\/span><\/i><\/div>\n<div class=\"parrafo\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">1. Se entender\u00e1 por <b style=\"mso-bidi-font-weight: normal;\">alojamiento dotacional<\/b> la edificaci\u00f3n<br \/>\nresidencial apta para ser habitada, que se configura como equipamiento o<br \/>\ndotaci\u00f3n, destinada a <b style=\"mso-bidi-font-weight: normal;\">resolver de forma<br \/>\ntransitoria y mediante abono de renta<\/b> o canon la necesidad de habitaci\u00f3n de<br \/>\npersonas o unidades de convivencia. Cumplir\u00e1 los requisitos establecidos en<br \/>\nesta ley y su normativa de desarrollo para <b style=\"mso-bidi-font-weight: normal;\">ofrecer<br \/>\na las personas que vayan a habitar en ella el espacio y las instalaciones<br \/>\nnecesarias<\/b> que satisfagan sus necesidades personales ordinarias de<br \/>\nhabitaci\u00f3n.<\/span><\/i><\/div>\n<div class=\"parrafo\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">2. Los alojamientos dotacionales <b style=\"mso-bidi-font-weight: normal;\">no ser\u00e1n objeto de su calificaci\u00f3n como<br \/>\nvivienda protegida,<\/b> y podr\u00e1n situarse, alternativamente:<\/span><\/i><\/div>\n<div class=\"parrafo2\" style=\"margin-left: 35.4pt;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">a)<br \/>\nSobre <b style=\"mso-bidi-font-weight: normal;\">suelos calificados<\/b> por el<br \/>\nplaneamiento urban\u00edstico para tal finalidad de <b style=\"mso-bidi-font-weight: normal;\">alojamiento dotacional<\/b>.<\/span><\/i><\/div>\n<div class=\"parrafo\" style=\"margin-left: 35.4pt;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">b) Sobre suelos que<br \/>\nel planeamiento urban\u00edstico califique de <b style=\"mso-bidi-font-weight: normal;\">equipamiento<br \/>\ncomunitario<\/b> u otro equipamiento que permita el uso de alojamiento<br \/>\ndotacional.<\/span><\/i><\/div>\n<div class=\"parrafo\" style=\"margin-left: 35.4pt;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt;\">c) En edificaciones<br \/>\no locales <b style=\"mso-bidi-font-weight: normal;\">preexistentes de titularidad<br \/>\np\u00fablica<\/b> que se destinen al efecto.<\/span><\/i><\/div>\n<div style=\"text-align: justify;\">\n<i style=\"mso-bidi-font-style: normal;\"><span style=\"font-family: &quot;Calibri&quot;,&quot;sans-serif&quot;; font-size: 11.0pt; line-height: 114%;\">3.<br \/>\nEstar\u00e1n destinados al <b style=\"mso-bidi-font-weight: normal;\">alojamiento<br \/>\ntemporal<\/b> de personas con <b style=\"mso-bidi-font-weight: normal;\">dificultades<\/b><br \/>\n<b style=\"mso-bidi-font-weight: normal;\">de acceso a la ocupaci\u00f3n legal de una<br \/>\nvivienda,<\/b> como j\u00f3venes, inmigrantes, personas separadas o divorciadas que<br \/>\nhayan perdido el derecho al uso de la vivienda compartida, personas pendientes<br \/>\nde realojamiento por operaciones urban\u00edsticas y otros similares.
