las Haciendas Locales<\/a>, concretamente en sus articulo 104 a 110 que han sido<br \/>\nmodificados por distintas leyes publicada en 2012 y 2014.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Es un tributo indirecto que grava el<br \/>\nincremento de valor que experimenta dichos terrenos y se ponga de manifiesto como<br \/>\nconsecuencia de la transmisi\u00f3n de la propiedad de los terrenos por cualquier t\u00edtulo<br \/>\no de la constituci\u00f3n o transmisor de cualquier derecho real de goce limitativo<br \/>\ndel dominio sobre los referidos terrenos.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Hasta aqu\u00ed el texto legal, descriptivo de la<br \/>\nnaturaleza del impuesto fue modificado respecto de la ley anterior en dos notas<br \/>\nfundamentales:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Sobre<br \/>\nel incremento de valor la nueva ley suprime la palabra real en coherencia con<br \/>\nel m\u00e9todo de calculo.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">En relaci\u00f3n a la base imponible (VI) del<br \/>\nimpuesto, seg\u00fan su art\u00edculo 107.1, que a continuaci\u00f3n transcribimos, se\u00f1ala:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Articulo 107.1<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">La base imponible del impuesto estar\u00e1 constituida<br \/>\npor el incremento de valor que experimenten los terrenos puesto de manifiesto<br \/>\nen un periodo m\u00e1ximo de 20 a\u00f1os.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">A efectos de la determinaci\u00f3n de la base<br \/>\nimponible habr\u00e1 de tenerse en cuenta el valor del terreno en el momento del<br \/>\ndevengo de acuerdo a lo previsto en los apartados 2 y 3 de este art\u00edculo, y el<br \/>\nporcentaje que corresponda en funci\u00f3n de lo previsto en su apartado 4.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Precisamente este articulo 107.1 ha sido declarado<br \/>\ninconstitucional y nulo por <a href=\"https:\/\/www.tribunalconstitucional.es\/NotasDePrensaDocumentos\/NP_2017_032\/2016-4864%20STC.pdf\">sentencia<br \/>\ndel TC de 11 de mayo de 2017,<\/a> b\u00e1sicamente porque somete a tributaci\u00f3n<br \/>\nsituaciones en las que no se produce incremento de valor. Como en el caso de<br \/>\nventas realizadas a perdidas.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">2.- El valor del terreno en el momento del<br \/>\ndevengo resultara de la aplicaci\u00f3n de las siguientes reglas:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 54.0pt; mso-list: l0 level1 lfo1; tab-stops: list 54.0pt; text-align: justify; text-indent: -36.0pt;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt; mso-fareast-font-family: Calibri;\"><span style=\"mso-list: Ignore;\">a)<span style=\"font: 7.0pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">En<br \/>\nlas transmisiones de terrenos, el que tengan declarado en el IBI.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">No obstante, cuando dicho valor sea consecuencia<br \/>\nde una ponencia de valores que no refleje modificaciones de planeamiento<br \/>\naprobadas con posterioridad a la aprobaci\u00f3n de la citada ponencia, se podr\u00e1<br \/>\nliquidar provisionalmente este impuesto con arreglo a aquel. En estos casos, en<br \/>\nla liquidaci\u00f3n definitiva se aplicar\u00e1 el valor de los terrenos una vez se haya<br \/>\nobtenido conforme a los procedimientos de valoraci\u00f3n colectiva que se<br \/>\ninstruyan, referido a la fecha del devengo. Cuando esta fecha no coincida con<br \/>\nla de efectividad de los nuevos valores catastrales, \u00e9stos se corregir\u00e1n<br \/>\naplicando los coeficientes de actualizaci\u00f3n que correspondan, establecidos al<br \/>\nefecto en las Leyes de Presupuestos Generales del Estado.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Cuando el terreno, aun siendo de naturaleza<br \/>\nurbana o integrado en un bien inmueble de caracter\u00edsticas especiales, en el<br \/>\nmomento del devengo del impuesto, no tenga determinado valor catastral en dicho<br \/>\nmomento, el ayuntamiento podr\u00e1 practicar la liquidaci\u00f3n cuando el referido<br \/>\nvalor catastral sea determinado, refiriendo dicho valor al momento del devengo.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Igualmente, declarada inconstitucional y nulo<br \/>\nel art\u00edculo 107.2. a) por id\u00e9ntico motivo<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Por \u00faltimo, el art\u00edculo 110.4, (Gesti\u00f3n<br \/>\ntributaria del impuesto) cuya redacci\u00f3n es la siguiente:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Art\u00edculo .110,4<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Los ayuntamientos quedan facultados para establecer<br \/>\nel sistema de autoliquidaci\u00f3n por el sujeto pasivo, que llevar\u00e1 consigo el<br \/>\ningreso de la cuota resultante de aquella dentro de los plazos previstos en el<br \/>\napartado 2 de este art\u00edculo. Respecto de dichas autoliquidaciones, el<br \/>\nayuntamiento correspondiente s\u00f3lo podr\u00e1 comprobar que se han efectuado mediante<br \/>\nla aplicaci\u00f3n correcta de las normas reguladoras del impuesto, sin que puedan<br \/>\natribuirse valores, bases o cuotas diferentes de las resultantes de tales<br \/>\nnormas.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">En ning\u00fan caso podr\u00e1 exigirse el impuesto en<br \/>\nr\u00e9gimen de autoliquidaci\u00f3n cuando se trate del supuesto a que se refiere el<br \/>\np\u00e1rrafo tercero del art\u00edculo 107.2.a) de esta ley.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Tambi\u00e9n en la misma sentencia ha sido declarado<br \/>\ninconstitucional y nulo este articulo 110.4 \u00fanicamente en la medida que somete<br \/>\na tributaci\u00f3n situaciones en que no existe incremento de valor.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Sigamos con la mec\u00e1nica del calculo de la<br \/>\nbase imponible en el momento del devengo, sea el valor catastral del terreno en<br \/>\nesa fecha o el modificado de acuerdo con las reglas establecidas en el articulo<br \/>\n107. 3 y 4. A dicha base se le aplica un porcentaje al incremento supuesto. Por ejemplo, en<br \/>\nla crisis inmobiliaria de 2008 los precios de venta de suelo y edificaciones<br \/>\ncayeron de forma notoria como media un 70 % los primeros y un 50 % los segundos<br \/>\ny sin que esa ca\u00edda de valor fuera recogida en el IBI de suelo y edificaciones<br \/>\ncomo ya han y hemos venido denunciando, los expertos en los que hay unanimidad,<br \/>\nen diversas publicaciones.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Ventas realizadas a partir de ese a\u00f1o y hasta<br \/>\n2012 \u2013 2014 fueron realizadas a perdidas, ya que hab\u00edan adquirido suelo urbano<br \/>\nmuy caro y los precios de venta disminuyeron considerablemente como ya hemos<br \/>\ndicho, con lo cual las perdidas en venta de terrenos fueron considerables,<br \/>\nhasta hacer que la mayor\u00eda de las empresas grandes y consolidadas del sector fueran<br \/>\nal concurso de acreedores u posteriormente a la liquidaci\u00f3n de sus activos,<br \/>\nliquidados en general con perdidas en los casos de solares o edificios, por las<br \/>\nque ten\u00edan la obligaci\u00f3n de tributar por el impuesto de IVTNU.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">En el a\u00f1o 2012 los promotores, considerados<br \/>\nculpables de la crisis, y los particulares que no ten\u00edan nada ver con ella, eran<br \/>\nconsiderados ciudadanos de segunda u no como el SAREB cuyas operaciones estaban<br \/>\nexentas de este tributo.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Pues bien, la sentencia del TC en mayo de<br \/>\n2018, viene a decir que en los supuestos que no exista incremento de valor, es<br \/>\ndecir que se transmitan los terrenos con p\u00e9rdidas no estar\u00e1 la transmisi\u00f3n<br \/>\nsujeta al pago del impuesto.<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Pero el tema no est\u00e1 cerrado puesto que el<br \/>\nParlamento deber\u00e1 dar tratante a lo derogado en la Ley Reguladora de las Haciendas<br \/>\nLocales y pasar\u00e1 alg\u00fan tiempo hasta que las modificaciones se aprueben ya que<br \/>\nel Gobierno pretende modificar todo el texto legal adem\u00e1s de este impuesto y,<br \/>\nconforme esta el clima parlamentario mucho nos tememos que se demoren los acuerdos<br \/>\nnecesarios en primer lugar con los Ayuntamientos. <\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">Pero aprovechando la reforma esperemos que se<br \/>\nintroduzcan varios aspectos en relaci\u00f3n con el IVTNU como:<\/span><\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 54.0pt; mso-list: l3 level1 lfo3; tab-stops: list 54.0pt; text-align: justify; text-indent: -36.0pt;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt; mso-fareast-font-family: Calibri;\"><span style=\"mso-list: Ignore;\">1)<span style=\"font: 7.0pt &quot;Times New Roman&quot;;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">ACLARAR<br \/>\nel c\u00e1lculo de los a\u00f1os<\/span><\/div>\n<div style=\"margin-left: 18.0pt; text-align: justify;\">\n<\/div>\n<div style=\"margin-left: 18.0pt; text-align: justify;\">\n<span style=\"font-family: &quot;Calibri&quot;,sans-serif; font-size: 11.0pt;\">En la practica de<br \/>\nmuchos ayuntamientos se toma el primer a\u00f1o como a\u00f1o 1, independientemente de la<br \/>\nfecha.
