rehabilitar debemos tener en consideraci\u00f3n su grado<br \/>\nde ocupaci\u00f3n o desocupaci\u00f3n en el momento de la formalizaci\u00f3n de la escritura<br \/>\np\u00fablica de recomendada que tiene acceso al RP, previa liquidaci\u00f3n<br \/>\nde los impuestos correspondientes, tr\u00e1mite que recomendamos sea realizado en el<br \/>\nplazo m\u00e1s breve posible. <\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">Inmediatamente<br \/>\ndespu\u00e9s<\/span><\/b><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\"> de firmar la escritura <b style=\"mso-bidi-font-weight: normal;\">se<br \/>\ncambiar\u00e1n las cerraduras impidiendo la ocupaci\u00f3n de terceros sin t\u00edtulo<\/b>,<br \/>\nreforzando en su caso, dependiendo del estado del inmueble y sus facilidades de<br \/>\nacceso style=\"mso-bidi-font-weight: normal;\">reservar unas cantidades para el caso de<br \/>\nque no se llegue al acuerdo con el resto<\/b>, estableciendo unos <b style=\"mso-bidi-font-weight: normal;\">m\u00e1ximos para negociar<\/b> las cantidades a<br \/>\npagar al resto de propietarios y las <b style=\"mso-bidi-font-weight: normal;\">indemnizaciones<br \/>\na inquilinos u precaristas,<\/b> en su caso, para las vivienda y locales<br \/>\ncomerciales.<\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">La<br \/>\nnegociaci\u00f3n puede consistir bien en dinero o en pago en especie<\/span><\/b><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">:<br \/>\nfacilitar <b style=\"mso-bidi-font-weight: normal;\">otra vivienda o reserva de<br \/>\nprecio y condiciones<\/b> para ocupar los locales en el edificio rehabilitado y<br \/>\nmientras procurar un local en las inmediaciones, con renta y obras necesaria<br \/>\npactada entre ambas partes, con alquiler temporal mientras duren las obras de<br \/>\nrehabilitaci\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">El<br \/>\nplazo y sus prorrogas para que se extinga la operaci\u00f3n deben consignarse en el<br \/>\ncontrato<\/span><\/b><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">Mencionamos<br \/>\nla diferencia entre realidad jur\u00eddica y f\u00edsica porque en la pr\u00e1ctica se dan<br \/>\nsituaciones que impiden al promotor iniciar<\/span><\/b><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\"> las obras de rehabilitaci\u00f3n del<br \/>\nedificio, aunque lleve raz\u00f3n documentada, <b style=\"mso-bidi-font-weight: normal;\">lleva<br \/>\ntiempo sacar al ocupante,<\/b> etc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">Por ello aconsejamos que <b style=\"mso-bidi-font-weight: normal;\">antes de firmar cualquier acuerdo <\/b>con<br \/>\npropietarios, inquilinos u ocupas, <b style=\"mso-bidi-font-weight: normal;\">se<br \/>\ncompruebe que han sacado todos los enseres y dejado libre la vivienda<\/b> o<br \/>\nlocal, para inmediatamente despu\u00e9s de la firma, <b style=\"mso-bidi-font-weight: normal;\">tener una persona que vigile que la vivienda o local permanece libre<\/b><br \/>\ny al recibir la llamada de que se ha firmado el acuerdo <b style=\"mso-bidi-font-weight: normal;\">proceda a cambiar la cerradura<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">&nbsp;<\/span><\/b><\/p>\n<p style=\"text-align: justify;\"><b style=\"mso-bidi-font-weight: normal;\"><span style=\"mso-bidi-font-weight: normal;\">se infiere la gran complejidad del asunto<br \/>\nde desocupar jur\u00eddica y f\u00edsicamente a los propietarios<\/b> o inquilinos de un<br \/>\ndeterminado edificio.<\/span><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;\">Por ello <b style=\"mso-bidi-font-weight: normal;\">si el inmueble est\u00e1 desocupado previamente tiene el m\u00e1ximo valor<\/b>,<br \/>\nque va disminuyendo en
